5/5/2016 - sent docs to Chicago, AGAIN (i-485, i-130, i-765, i-864) [Day 0] 5/16/2016 - NOA [Day 11]

5/6/2016 - delivered and signed up for by R Mercado [Day 1] 7/20/2016 - called to submit a service request for my EAD. [Day 76]
5/12/2016 - checks cashed [Day 7] 7/28/2016 - case numbers for i-130 and i-765 started working to say case was received on May 6 [Day 84]

5/16/2016 - got 3 NOAs in the mail, dated May 12, priority date is 7/29/2016 - case status of I-765 is "New Card Is Being Produced", later in the evening - "Case Was Approved" [Day 85]

May 6 (haven't received any emails or texts) [Day 11] 8/1/2016 - received answer for the service request "your case is under review" [Day 89]

6/10/2016 - got biometrics letter in the mail, notice date is June 4, 2016, which 8/1/2016 - received answer for the service request "your case is under review" [Day 89]

is day 30 from when they picked up the package [Day 36] 8/2/2016 - case status of I-765 is "The Card was Mailed to you" [Day 90]

6/21/2016 - Biometrics walk-in in Philadelphia [Day 47] 8/4/2016 - received I-797 Notice of Action for approved I-765 [Day 92]

6/22/2016 - Scheduled Biometrics Appointment [Day 48] 8/5/2016 - EAD in mail [Day 93]

6/30/2016 - online case status started working "case is ready to be scheduled

for the interview" [Day 56]

8/9/2016 - Interview is Scheduled [Day 97]

Oh shucks. Checked my status this morning. My I-485 status says: "Request for Initial Evidence Was Mailed"

Don't worry, it's not great seeing a message update like that I know but the majority of requests have been for little errors that can easily be rectified ok.

The hardest part of it is potentially seeing USCIS reset the 90 day clock for EAD/AP approval like some posters suggest on other boards here.

We are in their hands so to speak.... Hope it's a quick turnaround for you and keep the board updated on progress.

USCIS acknowledged receipt of my RFIE on the stroke of midnight so technically it says they updated on the 11th.

Relieved to see they have it in their hands! Less than a week since FedEx delivered it so that isn't bad at all.

Now to await their decision on what I sent in to them!

By chance I checked my case status website and it's working!!! Last update was May 9th saying fingerprint fee was recieved... Hopfully I'll get my bio appointment soon

You're right about the clock resetting - which essentially means I lost a month.

If USCIS issues a request for initial evidence, the 90-day regulatory timeframe will start over from the date USCIS receives the initial evidence.

For example, if your case is pending 60 days when USCIS issues a request for initial evidence, and you respond 30 days later, the clock will be reset to Day 1 on the date USCIS receives the evidence.

If USCIS issues a request for additional evidence, the clock will stop the day the request is issued and resume from the same point when USCIS receives the additional evidence.

For example, if your case is pending 60 days when USCIS issues a request for additional evidence, and you respond 30 days later, your case will be processed with the clock resuming at Day 60 on the date USCIS receives the additional evidence.

The clock will also stop if USCIS issues a request for initial evidence pertaining to the principal application/petition that serves as the basis for your application for employment authorization.

For example, if your eligibility for employment authorization is based on a pending Form I-485, Application to Register Permanent Residence or Adjust Status, and USCIS issues a request for initial evidence pertaining to your Form I-485, the clock for your Form I-765 will stop when USCIS issues the request for evidence and restart when USCIS receives the requested information.

so basically if you get an RFE you want to get the additional evidence letter and not the request for intial evidence letter since 1 restarts the clock and the other picks up where it left off. is that correct?

I'm sorry to hear this - it's most likely something you can fix easily. We're still awaiting the IRS tax transcript which is like torture when I already have everything else prepared in order to respond to the RFE :rofl:

Ckibs did you figure out how to resolve your RFE? Did you contact Uscis?

I didn't call the USCIS as I'm 110% sure they would give me some incorrect info anyways. We're positive that we got an RFE due to sending 2014 tax transcript as the most recent tax documentation since it's now past April 15. He IS way above the poverty guideline so I'm being stubborn not asking for his family to co-sponsor me. We have requested the tax transcript from 2015 as this is now available. We have filled out a new I-864 form and basically we're sending exactly the same documentation in response just with 2015 instead of 2014, 2013 and 2012 + 12 most recent paystubs instead of just 6.

- Of course we are also adding proof of him being an American citizen, employment letter and such like in the original packet :)

In response to our recently received RFE we requested the 2015 tax transcript from the IRS on May 9. It should be 5-10 calendar days before this arrives, hopefully it arrives sooner than later! I already have our RFE response printed and ready to go so as soon as we receive his tax transcript in the mall, I will be sending the response with priority express mail so it should be there the following day - I'll pay extra for this!! :rofl:

I'm okay with this RFE but it absolutely BLOWS that my EAD clock resets - I was soooooo looking forward to receiving my card the end of May / beginning of June. I really want to start applying for jobs! :clock: Hopefully I won't get too far behind.

It feels slighting unnerving to see all these RFEs but I think most of them may be like ckibs case and be lack of a tax return due to the time frame of tax season... I hope everyone's is minor and can be easily rectified like a missed signature or something

Not sure what is going to be next. I filed I-130 together with the AOS and I always thought the I-130 should be approved first...still happy to know they are working on it tho!!
