friends please help me, I sent my AOS package along with my daughter k1 and k2, we were worried because she only received two letters of acceptance to I-485 and I-131. We have just received the letter denying the I-765 form for lack of signature, and that's what I understood, please see the picture and help me understand it was only returned to the I-765 sheet showing missing signature, and the letter rejection, I can still send with proper correction, will have to pay the fee, send the 2 photos and other documents that we sent before? I am so worried because this rate is very expensive. What do you say?

Thank you- good information to know for others this may happen to.

I know I was out of status but there I additional paperwork you file that out your back in status of you I-94 expires and that needs to be filed before your AOS can be filed which is what my lawyer done... Although the my I-94 is expired I have official documentation that replaces the I-94 that has out my back in status... My immigration lawyer has gave me the ins and outs of my situation and yes I know I can't work that's why I've been a stay at home mom for all these years

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

19 Feb 2015: NOA1 Notice Date

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Just got back from the ASC / USCIS. My Biometrics appointment went smoothly. My appointment was scheduled for 10 AM but I showed up at 9:15 AM and I was out again by 9:45 AM. I had to fill out a form and then I was shown to a waiting area where I had to wait for my number to be called. My fingerprints and photo took maybe 5 minutes in total. The staff was nice and I felt like it went pretty effective. Don't sweat it!

Now it's back to being a waiting game :rofl:

Man, I think you really lucked out in getting that biometrics appointment nice and quick. I'm fairly patient, but I won't deny the disappointment I feel each day when there's no letter in the mailbox.

Nice to see a familiar face pop up, I remember seeing you on here when we went through the K1 process around the same time.

Not sure about anyone else, but I've been thinking I'll start applying for a few jobs, often the hiring process takes so long that it could work out around the time of EAD arriving. I figure I'd like to try and avoid the rush of job applicants when college seniors begin graduating!

I do not know what form it was all my lawyer said was due to the 1-94 expiring and so much time had passed I needed to file an additional form to replace the I-94... I think you'll be okie I think your expired I-94 okie for a short period of time after its expired but mine was 6years expired

It may of been form I-102 but I'm not sure... That form is for if you need to replace form 1-94 of you entered before June 2010 which applies to me so be I entered Jan 2010... I would need to contact my lawyer and to find out the form

Ah I see, yeah, I didn't do the math and figure it was from before the I-94s were electronic. We took a long time to do AOS because we were married (legally) right before Christmas and then it was BAM wedding in 3 weeks and life was super hectic. His I-94 expired right before the January wedding, and then the January wedding was cancelled due to a blizzard. I suppose we could have gotten our act together in Feb/March but part of me was just enjoying getting a break!

We're back on track now though :)

As far as I remember it says on the instructions that you may file them together or just submit your EAD form with the cont of the notice of action for the AOS

And then you won't have to pay the fee

And I guess it's their general response to everyone cause those are practically the only reasons they could have denied it

So you should put that letter they sent you with you EAD form and also write a cover letter saying that you have signed it and haven't attached any money cause you don't have to according to the category of filers you fall into

We're back on track now though :)

Main thing is that you married within the 90days that's the only important part... My understanding is that you can file with an expired I-94 but as long as its not years expired like mine then usics doesn't make a big deal about it

I tried to make sense of this but I just can't seem to wrap my head around it. The letter is saying that the fee you paid for the I-765 will be returned to you as it was an incorrect amount however you didn't pay anything for the EAD application since you sent it off with the AOS application - so what are they returning to you ??

The letter is also saying that you need to sign the I-765 and then resubmit it. On one hand I was thinking that you wouldn't have to send in photos and documentation since they're asking for it HOWEVER it doesn't state it's an RFE and they're saying your application has been denied and that they invite you to re-apply. I'm sorry but I'm afraid you'll have to send it all in again (the I-765 that is). And you'll probably have to pay the fee for the I-765 since it now probably will be considered being two seperat applications.

Just my two cents. That sucks! :/

Yea, I recognize you too :) I think we were both in the K-1 August Filers, right? :)

I see you got your NOA1 on the 7th, you haven't received the hardcopy yet ?? I received my Biometrics letter 20 days after the AOS packet was received by the USCIS. So I would think yours are on its way - if you haven't gotten the hardcopy NOA1 yet, it definitely seems like the pace slowed down for them :/

In regards to your comment about applying for jobs - I'm having the same concern. I have my resume ready and I've pre-searched and looked around in the area for interesting places and made note of where they're hiring. My plan is to apply as soon as I get the notification that my card is being produced! :) There's nothing wrong with going your route, I would just hate it if the hiring process for some reason didn't take a while and me missing out on a job opportunity.

4/27 - received Biometrics appointment letter

5/09 - Biometrics @ 2 pm

6/15 - called USCIS as there was no further info since the Biometrics appointment

6/16 - EAD/AP cases updated - card is in production
