Anyone who has or gets the medical RFE-- I just heard back from my Congressman's office who contacted USCIS for us. They said that the RFE was sent in error and that our file has been put back in for normal processing. The exact wording of USCIS's response makes it sound like if it goes to a field office for processing, that the K1 package and the AOS package aren't sent together or something. But NOW they have the K1 package with our medical info in it so we can ignore the RFE. Saved us $500 right there. Worth it to me!

Just make sure that you are *clear* with your Congressman. Explain it in bullet points if you need to.

  • Had medical abroad for K1 visa
  • Packet given to CPB as required
  • Applied for AOS
  • Followed the instructions you see here (link to the instructions): medical was done within 12 months of filing, and DS 3025 was properly completed.
  • Not sure what they're asking for. Is a paper lost? If so, do we need full medical or only vaccination supplement?

That should clear it up.

Right. The problem is that even though a lot (most?) of us know that going in, a lot of people are getting an RFE asking for it. We did. But instead of going to do another medical, I contacted our Congressman's office (they have liaisons to help work through issues with Federal agencies--it's not the the drama queen move it sounds like. It is legitimately how you sort through issues exactly like this. I used to do that job, so I'm very familiar with this), who contacted the field office directly, who looked into it and basically said "oops our bad, we have the medical file now. Ignore the RFE, you're back in the normal processing line".

Hey guys! Yesterday I called USCIS to try and get some status update on my case (Last thing I heard was June 30th, they received my RFIE).

I thought that the processing times of cases started counting once it was transferred to the local office, so I wanted to know if it had been transferred to Dallas or not, to start counting the 11 months of wait.

  • First person who picks up, said she was gonna get that info for me (no need of a tier 2??) but then she said the systems were down and to call again in 3 hours.
  • 3 hours later, second person who picks up, tells me that the only way for me to know if my case has been transferred, is to make an Infopass at the Dallas office and ask. Is that true??? I thought tier 2 could tell you that info!!

He also said that processing times for your case starts counting from the day they receive it, even before it's transferred to the actual office with said processing times. Is that true also?

My WHOLE AOS case has revolved around USCIS people contradicting each other, so I don't want to keep calling, do you guys know what's true and what's not?

Tier 2 can access that information for you but some people prefer a info pass appointment cause they prefer face to face talk vs over the phone... the clock starts ticking from when Uscis receive your file since... just remember not all cases get transferred to local offices that's why all cases start ticking from day recieved at uscis... FYI allot of k1 cases never leave NBC cause NBC can approve cases there also

I just sent my letter and I hope I was clear enough. My letter was 2 full pages. :shocked:

You're making me want to re-write it and re-send it now!

I would call their 2 and wnquire about if your evidence you sent was sufficient or not they will be able to tell you that at least... the cases that gets waived either get sent out to a random local office not always YOUR local office to be approved or they remain at NBC for approval... if you need an interview then your case MUST to sent to YOUR local office

Hi all,

I emailed my local congressman to see if our interview could be scheduled asap because I wanted to travel home. The secretary did follow up and email NBC but they responded with no new information - basically saying that our case is pending interview and that it's now with our local office here in NY. I wonder if the secretary should have contacted the local office in the first place not NBC. Should I request she contact our local office? Or is that really all they can do?

Hi AngelaSimmons,

I had a similar occurrence happen to me and my local congressman contacted the local office. They requested that I write a letter explaining my situation and why the interview should be moved up earlier - for example, for family reasons, etc. I would go with the congressman contacting your local office.

December 18, 2015 - Initial sputum tests done! Results are negative                             June 3, 2016 - per case status online i-485 "Ready to schedule for interview"

February 10, 2016 - received email from SLEC sputum tests negative                           July 5, 2016 - 1st SR for EAD (75th day from the received date)

February 17, 2016 - SLEC medical done!!!                                                                       July 16, 2016 - recieved an email EAD case is under review

February 23, 2016 - USEM interview approved! The CO has only 3 questions! LOL        July 22, 2016 - 2nd SR for EAD (92nd day from the received date)

March 4, 2016 - K1 visa packet received!!                                                                      August 2, 2016 - EAD status changed to New Card is being produced

March 8, 2016 - CFO seminar done                                                                               August 3, 2016 - EAD/AP status changed to CASE was APPROVED!

March 19, 2016 - arrived at my POE Los Angeles                                                          August 9, 2016 - EAD/AP combo card received!

                                                                                                                                     September 28, 2016 – Case status changed to “Schedule for interview”

                                                                                                                                     October 28, 2016 – Interview day!
                                                                                                                                     November 2, 2016 – received RFE (IO wants all pages of Form I-693 to be filled out by CS)
                                                                                                                                      November 12, 2016 – RFE response sent!
                                                                                                                                      November 22, 2016 – AOS APPROVED!!

                                                                                                                                      December 2, 2016 – 2 year conditional green card received!
