Hi guys, I just got a letter in my mailbox. Couple days ago I made a request about my case - it's one of the tools online.

They sent me the letter with more detailed status than you can see online, so I think it's worth it.

They got my RFE response on May 20th (thanks for letting me know earlier.. :D ) and my case is still pending and within a normal processing time... That's all ever wanted to know!!! :) So, I'm very happy!

I was wondering about that tool! So it wont delay your case even more? I thought its kinda like the same what a tier 2 would tell you on the phone.. Edited by DerGraf88

april 1st: sent i-485 to chicago lockbox

april 4th: i-485 delivered to chicago lockbox

april 7th: "biometrics fee received and accepted"

april 10th: email notification of acceptance and routing to NBC for processing

april 11th: hardcopy i-797C in mail (notice date april 8th)

april 30th: received biometrics letter for: may 11th @ 9am

june 2nd: received interview letter for: july 6th @ 11.10am

july 6th: Interview day---no decision was made

july 13th: sent e-mail to congressman, asking for an inquiry on my case.

After a very disappointing call with Tier 2 yesterday, in which they told me to call again in two weeks because another SR could not be put in until 30 days after the first one... I just checked my online status and it's finally working! My new card is being produced!!! Finally! About darn time!

AP case is still not working but I'm guessing it will, eventually.

So VERY happy!

hey guys! I have a question about banking.

I opened a Wells Fargo Checking and Savings Account. Yesterday, I got in the mail this "Form W-8BEN, Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding" . From what I understand, it's because the savings account that I got this form for. I've done some research, but overall I'm not convinced that I have to fill it (if it helps any, when I opened the account I didn't have the EAD yet, so I opened it with my passport and marriage license). Did anybody have to fill this one out?

I'd ask the bank, but in my experience nobody usually knows how to deal with me in this limbo state that I'm in without GC

I have never seen that before BUT I would guess you can ignore it since you aren't with holding any tax since you don't work due to not having an EAD... Can you not contact the bank??

I did. We aren't supposed to, but my bank made me do it. They said while I don't have a green card, this is the form they need from me

I will, but like I said, they usually don't know what to do with me in this status limbo, so I wanted to do some research to show when I asked them. Btw I do have the EAD now and started working yesterday, but we'll see what the banks says about it

So I can either just fill it up and provide the documents they ask me for (copy of foreign government issued document and letter of explanation) or contact my banker and ask her to make sure... I'll probably just fill it up and send it and update them whenever I get my GC.

Do you have a SSN? You should only have to do a W-8BEN if you don't have a social security number. Originally when my fiance came into the US, we went to add him to my bank account as a joint holder and they wanted him to fill out a W8-BEN, We just went ahead and waited until he has his SSN card and added him on with that info and had no issues.

Just an update to everyone. After receiving the EAD two days ago, we went to our local SSA office today to get a SSN number. The guy there told us that the EAD was not yet registered in the system (understandably).

He asked us why my wife didn't get an SSN under her K1/I-94... we said we thought that the legal employment status was required for an EAD. Well, apparently getting an SNN pre-EAD is not only possible, but recommended. Now we must wait 2-4 weeks for the SSN card, since the guy who assisted us needs to wait for the DHS to confirm that she has her EAD (this is a direct consequence of the EAD not yet being registered in the system).

For all those waiting for their EAD, unless it's going to arrive very soon, i'd recommend going to your local SSA office asap with your passport, birth certificate, and marriage certificate. Once your EAD arrives, all you'll need to do is return to the SSA office with your marriage certificate and change your last name.

If you already have your EAD and don't yet have your SSN card, perhaps wait 3 or so business days before going to the SSA, that way it's certain that everything is in the system.

I received my GC already last july 7,and im still using my lastname not my husband's lastname..So is it ok to go to sso and apply for ssn and change my lastname?is it not going to have a problem that my GC and SSN are not same surname?

My bank still made me do it. I tried to argue that I'm a us person, will file taxes this coming year, filed my taxes back home as a person who left the country, have a ssn... The bank person even called someone from corporate. But because I didn't have proof of legal residency, they made me sign the w8ben
