I'm pretty hangover today actually ?

april 1st: sent i-485 to chicago lockbox

april 4th: i-485 delivered to chicago lockbox

april 7th: "biometrics fee received and accepted"

april 10th: email notification of acceptance and routing to NBC for processing

april 11th: hardcopy i-797C in mail (notice date april 8th)

april 30th: received biometrics letter for: may 11th @ 9am

june 2nd: received interview letter for: july 6th @ 11.10am

july 6th: Interview day---no decision was made

july 13th: sent e-mail to congressman, asking for an inquiry on my case.

I have a friend, they got married here in USA, 2 weeks after their marriage the husband left her for another girl. Her husband doesnt want to file AOS and is now living with the new girl. I think she should contact a lawyer! He will probably refuse to pay childsupport as well, so she needs to get a lawyer to get everything she is entitled to!!

If she's in the US, then that means that he signed the Affidavit of Support. If I'm not mistaken, your friend can sue. Get a lawyer now

i dont think there is much so can do.. i would try a lawyer but mostly likely i think she needs to go back home... i know if you get married and there are loopholes a spouse can use example an abusive relationship there is loophole that the spouse card apply for greencard to get away and break free without there partner knowing about it without a sponcer and other stuff but i dont think there loopholes for partner wanting to break the marriage off... what i would do tell her to go get her SSN so she can atleast get healthcare for prenatal care and atleast get a bank account and other stuff in the meantime but wihtout the greencard he is not legally responsible for supporting her financially.. If shes unable to get a SSN if her window has expried then she can apply for an ITIN which wioll also enable her to get a bank account and healthcare and other stuff

If she's in the US, then that means that he signed the Affidavit of Support. If I'm not mistaken, your friend can sue. Get a lawyer now

dont hold me to this but i think the affidavit of support you do for the k1 just shows that you can financially support them but they are not bound by law to supporting them until the green card is approved.. i could be wrong.. with the green card aslong as the green card is valid they are bound to them by financially supporting them regaurdless if there still together or not but the k1 your technically not bound to supporting them if 1 they fail to marry with the 90days or 2 they marry but split up before AOS is filed then the affidavid doesnt mean anything cause the conditions of the visa weren't met

remind her that she legally can only stay in the usa for 90days anytime over that is regaurded as unlawful stay... 6month unlawful stay is 3yr ban anything over that i think is a 10yr ban from the country... whatever she chooses to do she needs to think fast

Just got off the phone with uscis. Super rude guy i had to talk to. Said there is nothing he can do and told me the processing times for the my field office. "Just because you already had an interview, doesnt mean anything."

Correction on my part: If the beneficiary becomes a public charge, then the government may sue him. It says it near the bottom of the affidavit.

On the other hand, if they filled out the AOS, then the beneficiary can sue the petitioner.

But what does your local office processing time have to do with a document being transfered??? It makes no sence... Once they receive that document it should go directly to the officer in charge of your case for instant approval... He's talking as if your file got put to the bottom of the interview stack which doesn't apply cause you already had an interview

Which visa she used to get here? Anyway, if the usc husband doesn't want to file her papers, she can't file alone. (Unless she has a domestic violence case, and you didn't mention anything) She can try and work things out with him, otherwise better to go back to her country and not overstay.

I doubt a lawyer can help her stay in this situation but could be useful to child matters though.

Yes, i agree! He wouldnt let me talk at all, kept interrupting me and said things like " let me talk to you a little slower so you can understand how this works."

He is the one that didnt understand at all!!! Ugh

How high are the chances that if i call again that i get a different one on the phone?
