Hello

Please i would like to know how you went about getting a US driving license before your AOS application goes through

i'm on day 65 with my AOS application, still waiting after i sent RFE package to chicago, application might take a bit longer

i have a court deadline to get my US driving license , so i was thinking if there are other option to get the driving license without GC/EAD card

i will appreciate a reply to know if there are open options to acquire a US driving license with other identification documents

Thank you.

I actually talked about my experience, because I was trying to encourage others to get theirs, but I got replies that it unfortunately depends on the state you live in. For me, I needed to bring my I-94, SSN, a proof of my address, and passport. I had to pass the vision test, written exams and driving exams. I went to the main office, but they redirected me to another one for foreigners where they checked if I had all documents right and then went back to the main one. It was actually very easy and I got the driver's license in the day of applying.

Definitely try it! It's really worth it, if possible. You don't have to have your passport with you etc., but just by the way, I drove before getting my american one. I just used my Czech one. I never got pulled over, so not sure if it's allowed, but we have no public transportation here, so I'd have to be at home all the time..

Same here, i have been driving with my international DL till i got into a minor motor accident, i had a fair judgement with the fines

they asked me to get a US drivers license like asap , so i have to avoid driving till i am able to acquire the a US license.

One more thing, Please how do i go about getting the I-94 ?

Thank you.

I-94's are when you entered the country. You would have had one for the 90 days you entered on a K-1, but you won't have one for AOS. Your I-94 from your last entry into the country should be found here: https://i94.cbp.dhs.gov/I94/consent.html;jsessionid=6sCMX5vKJCpw230mNTT8cH3VhGsJv1JWgJ8qXygJ2c8Pmnf4pGV3!-190711639

The way you prove that you're in the country legally, is by showing your I-797 from your AOS application.

Some places suck at doing DL's though. My husband went to get his, using the I-797 for proof of being lawful since Texas accepts I-797 NOA1's showing that he's applied, but the lady put in that he had a green card, so when the system kicked back that he didn't have a green card at the time, the documentation they were asking for was the GC or the I-551 stamp in the passport. We didn't have it at the time, but we'll be going back once he gets his GC.

Make sure it's put in the system correctly. The lady tried to argue that she had to put in that the document type was a GC because that's what we applied too, even after explaining that the document type should be the I-797 and showed her the acceptable documents list, she told us that if it doesn't work we can just try again and do it another day. lol.

Personally I'd wait til you had your EAD or GC.

Also, Texas only allows driving without a texas liscense for the first 90 days of entering into the state. Past that, you'll most likely told to get a US lisense.

Hey!! I went to get my drivers license here in texas and it was a frustrating thing, but I think I know the solution for you.

When I went, my I-94 was 1 day away from expiring. I didn't care, since I knew people HAD gotten a TX drivers license after the 90 days and without an EAD/GC yet. They processed me, I passed the whole thing, but by the time I took my road test, it had been a couple weeks and when they went to print my license, the system told them that it was all invalid and I couldn't get the license until I had the GC because my I-94 was expired. I was furious, since it doesn't make any sense for this country who relies only on cars to allow me to get a EAD to work and then the state won't let me drive to the job. So I went back home, did a looooong research and found out how to do THEIR job for them so they can approve it for you before the EAD (they didn't even know you coud get it with the EAD)

I found a post here (that I can't find now!! so I'll have to rephrase it) of someone who successfully got the TX drivers license withouth EAD/GC. What happens is that they run your I-94 on the SAVE system to know if you are allowed to stay here legally and get a license. The SAVE system tells them that you are past the 90 days allowed by the I-94 from your K-1 and that's it. What they do wrong, is that they have to run your alien number on the SAVE system, NOT your I-94. Once you apply for AOS and the I-94 has expired, your proof of LAWFUL PRESENCE is the I-797c which shows that your AOS is being processed, not the I-94.

Here is a list of accepted docs that will allow you to prove the lawful presence.

https://www.dps.texas.gov/DriverLicense/documents/verifyingLawfulPresence.pdf

you aren't under a K-1 anymore, so you look for

Applicants for adjustment of status

Immigration documentation with an alien number or I-94 number This can include but is not limited to a form I-797 indicating pending I-485 or pending application for adjustment of status.

The person on the post I saw, said that once they run the alien number instead of the I-94, they won't find you in the SAVE system, so they will have to run a "manual" check, which means you'll have to go home and wait about a week for a letter on the mail that says that you are OK and you take that letter with you back to the DMV to go ahead with the process.

She suggested to print the relevant page of the link I showed you, just to prove it to them that you are allowed to get the DL and make them run the alien nr instead of the I-94. To further test what she said, I went to the SAVE website and ran my I-94 number myself and alien number too, and she was right. Under my I-94 it showed that the DMV had checked it out but when I typed my alien number I got an error back.

People who commented on that threat said that they also had successfully done it through the manual check at the DMV.

As you can see, doing it without a GC/EAD isn't easy, but it CAN BE DONE if you are willing and prepared to push and insist at the DMV for people to do their job. I assume some people won't like it and will still say no just because it seems like a lot of work, but you should try it. In my case, I am so close to getting the EAD (hopefully) that I will do it then and save me the pain of arguing with the DMV again so soon.

I hope this helped and best of luck!

congrats!!!!! you are so lucky! my EAD was also updated as" new card being produced" on 24th June. but since then, no update. haven't got anything yet. I will be moving to another state soon, should I change the address now? or should I wait until I get the card? Thank you!

Well, I feel you should wait for your EAD card first. I feel it is really close to being mail, if I was you I would wait till the a week or so before moving and then put in for Change of Address request. As it takes a week before it gets processed so if your EAD card gets mailed between that week you still are at your old address and get it whereas if it gets mailed after the new address change you would get it there.

Hey guys, my online status still says "RFE was mailed on May 9th".. Should I do something? Can I even do something about it?

They haven't even told me if they've received it or not..

Thanks!
