If your wife came to the USA on the K-1 you need to apply for SSN within 75 days or so of arriving in the USA, K-3 visa holder needs EAD or Green Card to get SSN.

Your profile has no details, so it is hard to give a solid answer. Since I don't know what state you are in I can not answer about DMV, in my state NY they need EAD, or Green-Card as well as SSN for a drivers license.

:time: It helps us tell what visa your wife is on so you can get better advice. :D

If she's on K1, she is allowed an SSN - the instructions on the application for a SSN tell you what documents you need.

This memo advises that K1 visa holders can receive an SSN (lots of problems at SSA with this). If you've already married, people tend to have more issues getting one, but I think you have to get it within 76 days of entry into the country on the K1 visa.

If you're adjusting from another nonimmigrant visa such as B1/B2, F1, J1, etc., not so easy, as she's not eligible for an SSN and therefore may not be able to get a driver's license. My husband is adjusting from a tourist visa and brought his I-765, I-485, and I-130 NOAs with his passport to the DMV and the girl pretty much told him, "Well, you came here legally and you've applied for a green card, okay!" but I am shocked she allowed it as most people get a hard time at the DMV, esp in FL. If you're in the same situation, try it but don't expect it to work.

Hi Dza69,

Good luck on your immigration journey. From my experience here in New York State, I got my (Ontario, G2 level) Canadian license transferred over, as NYS has an exchange agreement with Canada. I only had to pay the $40 license fee, which is good for 5 years. No written tests or road tests required for me either. Only a quick reading of the eye chart for the vision test was required (easy, peasy). What's needed for a NYS driver's license though is a SS#, which I got a couple of weeks later after I got my Green Card. Meanwhile, throughout the entire time I was in the USA, I just drove with my (Ontario) Canadian license, which was perfectly legal to do. The only frustration I had in driving with a Canadian license was that was still in my old maiden last name (which I really hate), not in my new married last name (which I really like).

By the way, it is definitely a lot easier to drive in the USA and to get a license here in the USA it is easier too. No more G1, G2, G, graduated licencing ####### to deal with...Grrr.....Lucky me, I skipped the Ontario G2 exit/G test, and got a full/unrestricted NYS driver's license here!
