Can they deny your K1 Visa AT ALL if you're denied entry?

Hi!

I am wondering if I try to cross the USA border from Canada after we submit our K1 Petition and get denied entry at the airport can they in any way deny the K1 visa petition OR use it against me in the interview/during the petition process?

My fiancee and I really, really want to see each other in his hometown during the petition is being processed.
I'm aware of the ''Yes, you can visit!" thread, but it didn't address this specific subject of this topic from what I can tell.

Thanks!

Welcome to the forum.

The circumstances of your hypothetical situation may likely depend on the outcome of your background check, or whether you have lied, or were less than forthright, on any of your applications, and the nature of those transgressions. If you want a specific answer to a specific subject you have to be more specific in what you are inquiring about, i.e., avoid using the term "any way."

A general listing of specific grounds of inadmissibility used by the USCIS can be found page 1 of the instructions for Form 601: https://www.uscis.gov/sites/default/files/files/form/i-601instr.pdf

Good luck on your immigration journey.

Seems counter productive. Assuming you mean they deny you entry because you intend to immigrate on a K1....then later deny your K1 because of that? No, won't happen.

If you're asking you get denied entry for having a gun, drugs, and a bomb at the airport then of course it would affect your K1.

You said ANY way. Yes of course there is a way.

A plain denial of entry at the border is a) unlikely and b) would not affect the K1, unless you end up lying to the border control officers.

Not usually.

My fiancee and I really, really want to see each other in his hometown during the petition is being processed.

Come on over.

I'm aware of the ''Yes, you can visit!" thread, but it didn't address this specific subject of this topic from what I can tell.

Unless you are found to be a terrorist or are smuggling contraband and then are put on an international do not allow this person in list, any denial does not affect the K-1.

They gave me a paper saying at this point in time I wasn't admissible and I was denied entry last time I tried entering. No ban or anything.

So how much ties to Canada do I need? On the paper it says bank statement, letter of employment, bills in your name to your Canadian address, etc, etc.

I mean I know it's tricky to say but how much proof should I be prepared with?

It says to bring the paper next time - do I have to?

It says to bring the paper next time - do I have to? Quite likely, if you want to gain entry to the US. Sounds like you have been flagged by Customs and Border Protection (CBP). Don't play games with them, they can seriously ruin your day. ;)

Good luck on your immigration journey.

You answered your own questions.

Thread is moved from the K-1 Process forum to the Working & Traveling forum -- topic involves travel during the immigration process.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
