I have been working on my wife's packets for some time now (I am born USC) and finally have the info and money together. Will be filling I 130 and I 485 AOS concurrently.

Quick history. My wife and I have been married 10 years, married in Brazil and lived there for the last 10 years. We have 2 children born in Brazil and have dual citizenship. Arrived in the US late Nov- 2015 to visit, wife has tourist visa and can stay 6 months. Decided to make the move to the states permanent because of the age and health of my parents. My income while in Brazil was very low. I am self employed here now as a carpenter.

No steady checks to show from one employer how do I show my income.

My Parents will be joint sponsor, we do NOT live with my parents what is the size of household income they need to show, just the two of them that live in their home or all of us? So household size 2 or 6? Or do I file I 864 as a household of 4 and them separate I 864 household of 2. I guess my question is 125% of what?

9/2005 returned to Brazil asked her to marry me. :dancing:

11/2005 moved to Brazil and got married.

6/2006 daughter born in Brazil.

11/2006 took wife and daughter to meet my family in US.

10/2012 vacationed in the US 3 months

3/2014 2nd daughter born in Brazil.

11/2015 visited US again

12/2015 decided to start AOS.

4/4/2016 mailed AOS package

4/6/2016 AOS package received.

4/19/2016 received text AOs received and checks cashed

4/23/2016 received hard copy I-797c for I-485 and I-130

4/29/2016 received biometrics notice, scheduled for 5/10/2016

5/10/2016 Biometrics done, Nashville Tn.

5/20/2016 Received RFIE on I-485

5/31/2016 mailed response for RFIE

6/6/2016 NBC office received response to RFIE

6/13/2016 received notice that case is ready to schedule for interview.

6/22/2016 received notice for interview set for 7/25/2016

6/25/2016 received hard copy in mail for interview

7/25/2016 interview AOS approved.

7/28/2016 received I-797 for AOS approval

you file the i864 regardless of income, your household size is 4: you, your wife, 2 children

the household size for your parents is 3, mom, dad, wife

if one of them doesn't make enough income to cover 3, then one of them files the i864 as your joint sponsor, and the other spouse files the i864A as his or her household member to combine income

Ok so to make sure I understand, I am the petitioner regardless? I will file I 864 even though my income is not enough and my parent (father) will be (the only joint sponsor) and file I 864 also to send in with my wife package? His income must be sufficient for household size 3?

correct, you will attach a letter explaining why you haven't filed taxes, it is an obligation for USC to file taxes if they were required to, regardless of where they live

your father will be your only joint sponsor and needs to cover 3 people

Thank you so much. that helps a lot. But yes I did file taxes even though I did not make much money. Under 10,000 US dollars per year while in Brazil.
