Hi everyone!

My fiance (beneficiary) arrived here in US last week. We will be getting married on Monday and planning to file for an AOS next week. I have seen here that it needs to have a copy of my fiance's birth certificate. She wasn't able to have a photocopy of it and now I am just worried that it might cause an RFE if we are not able to have it on the packet. Does it really need to have copy of birth cerftificate? or Will I be fine without it? I hope you could help me. Thanks.

Submission of a copy of your foreign born spouse's birth certificate, conforming with USCIS document translation requirements, is an initial requirement for filing the I-485 application, refer to page 3 of the Form I-485 instructions: https://www.uscis.gov/sites/default/files/files/form/i-485instr.pdf . This is not a new requirement. Suggest that you do not submit your I-485 without it.

My wife brought several additional copies of those types of documents when she came to the US. Suggest that you consider getting additional copies at this time.

I always tell members to make sure the beneficiary brings an original birth certificate to USA with them.

She needs to have NSO certified copies of her birth certificate. Should have several as you will need them later...otherwise...could be a problem. USCIS and NVC are rather particular about this. She must have an NSO certified copy! Hope it all works out for you. Hopefully, she has all of the other NSO documents - as well as police clearances, if necessary. Can't imagine that she would be able to come her without all of that. Not sure why you didn't know she needed to have NSO docs before arriving here...just sayin'!

I also needed a copy of my birth certificate to apply for the marriage license so if you haven't looked at that yet it might be a good idea to sort out asap. I thought I didn't have my original certificate and had to wait for my mum to mail an additional copy to me to get my license...only to find it was in my paperwork packet after all... which was delightful!!

Currently filing for AOS.. So we need certified copies of birth certificate? I'm not sure what NSO copies mean, but do we need certified copies of anything else? I thought I read somewhere on VJ that the copies can be simple straight from the scanner at home copies.. I guess I was wrong?

NSO - National Statistics Office. It's only for people who lives in the Philippines. I got my certified copy of BC through online E-Census: https://www.ecensus.com.ph/default.aspx

She has to pay $20-25 I think.. and it will be delivered between 2-4 weeks but you can expedite it. Just read the link mentioned above how to obtained her certified copy of Birth Certificate. Also, she can ask her friends or family in the Philippines to get on her behalf. The requirements are authorization letter and attached her passport copy , it's only 150-200 pesos and it can get at the same day. Then she can ask her family to send it to you via FedEx or DHL.

We got RFE'd for a birth certificate too. We ended up having to get one from the Turkish consulate.

Unfortunately, Birth Certificates ARE a big deal..

we just got done with our AOS Interview today (passed! yay!) and as weird as the interview was (they really only asked us for 3 things: marriage cert, passports and her birth certificate)

thank god my wife made copies of her b.c. because her original was actually taken during this entire K-1 process to get here..

btw.. the officers having done this so much know exactly what a Philippines b.c. looked like because my wife had another "Certificate" .. not sure what it was tbh but the ISO was like "that's not a philippines birth certificate"

like i said, thankful that my wife had a copy of the actual b.c. she submitted.. which the ISO found in our paperwork which he returned to us today and he took the copy

so yes.. do it right.. don't mess around with birth certificates.. make sure it's proper and copies will suffice but your problem is you don't have a copy so secure an original one..
