Jamie Gilt, the gun advocate from Florida whose 4-year-old accidentally shot her in the back earlier this month, could be charged with a misdemeanor related to unsafe storage of a firearm - and "should be," according to her local sheriff's office. The penalty for that charge is 180 days in jail.

At a press conference on Tuesday, Capt. Gator DeLoach [Editor's note: best name ever, right?!] explained how it's believed Gilt's toddler managed to get access to her firearm, which didn't have a trigger lock. "The investigation revealed that Jamie placed the gun, which was not in a holster, under the front seat of the truck," he said. "Sometime during her drive, the gun apparently slid back to the rear floorboard, below where her 4-year-old son was seated in a booster seat. According to family members, the child recently learned to unbuckle his seatbelt. Investigators discovered the child removed himself from the seat, presumably to grab a toy from the floorboard, saw the gun, picked it up and accidentally fired through the rear of the driver seat, striking Jamie. The bullet struck her in the back and exited through her chest."

Reuters reports that prosecutors will now decide whether to move forward with the charge. In the meantime, relatives are caring for the little boy, and the state's child welfare agency has also been investigating the case.

They need to do this more often. The only way to make people responsible is to hold them accountable.

I've posted before about a former co-worker who was facing 12 years in jail. She left her 3 year old at home on the bed and he found a firearm under the pillow and killed himself. She also lied to police about the circumstances. Ultimately, she ended up getting 14 days in jail and probation. Complete failure of the justice system if you ask me. The message needs to be stronger.

I've posted before about a former co-worker who was facing 12 years in jail. She left her 3 year old at home on the bed and he found a firearm under the pillow and killed himself. She also lied to police about the circumstances. Ultimately, she ended up getting 14 days in jail and probation. Complete failure of the justice system if you ask me. The message needs to be stronger.

OMG left him alone and he killed himself. That's really murder. She killed her baby. That was a slap on the wrist for taking the baby's life. 14 days in jail. What a failure of the system for sure. How sad, I'm officially depressed now

Alabama Boy, 4, in Car With Siblings Shot While Mom Shopped

Police in Alabama say a 4-year-old boy is expected to recover after he was shot in the head while left in a car with siblings while their mother went into a store.

A Birmingham police spokesman, Sgt. Bryan Shelton, says the boy was injured after one of the children found a gun in the car and picked it up. He says the weapon fired but the bullet only grazed the boy's skull.

Al.com reports (bit.ly/1MpMcKl) the boy was in stable condition at Children's of Alabama hospital following the shooting Thursday night.

Shelton says police don't expect to file charges in the case. He added, "If you choose to own a gun you have to be safety minded and exercise a higher standard of care."

I take the same view here I do of somebody who leaves their kid in a hot car who dies. They made a mistake, they received a punishment far worse than the law can met. So let it go; they won't do it again.

According to people I've talked to, she has not learned her lesson. The judge was not the only one to remark on the displays of callous behavior and lack of remorse.

At any rate, criminal negligence is criminal negligence. If she had left the child unsupervised in a pool, or forgot to give him water until he died of thirst, they would have punished her to the maximum extent of the law. The negligence involved in leaving a gun under a pillow and putting a three year old on the same bed goes beyond a simple mistake. People seem to forget that justice is for the victim too.

Except if she was black, liberal or Muslim, then she should be given a life sentence. Everyone who is a WASP would have receicved enough punishment.

The price of firearms lessons are often steep. So if mommy dearest in this little story was say drunk driving, crashed and her 3 year old died in it, 14 days would be sufficient punishment in your eyes?

The justice system recognizes that a sentence is not just punishment, but in some way's a deterrent. I don't think this sentences like this serve as a deterrent to anything.

It didn't deter anything. Giving a harsher sentence would have hurt gun super advocates feelings. Giving harsher punishments for gun related accidents would mean there's a gun problem. Losing 1000s of kids a year to guns is just sad and highlights the lack of priority in our country.
