Pending EAD (with AOS from K1) but employer wanting to hire ASAP

Well that's not as helpful as I was hoping... I thought it was just if he had a job offer then we could ask for an expedite.

You can do it with a job offer. If you have a letter. I saw a lot of people here in the forum.

Try for Financial loss.

How can we do that!? :) Is that something we can do on the phone with USCIS or is that more paperwork?

Call USCIS call center and place a request to expedite.

They will ask you a reason - put # 1, "Severe financial loss to company or ​person​". They will give you a # of your request (Referral ID).

Within 5 days (or so) you should receive a email or regular mail:

"Type of service requested:

-- Expedite

The status of this service request is:

Upon receipt of your request for expeditious handling, your case was reviewed and a determination was made that we need additional information to make a decision regarding your request. Please fax proof of your financial loss, such as proof of a pending job offer, to the following number: 816-251-2290, Attn: XXXXXXXXXX. Please include this notice with your fax. Documents should be submitted with an official letterhead"

I faxed my pending job offer along with a Cover Letter, where I explained why it could be my financial loss.

It took 2 weeks to receive my EAD after placing the request to expedite. It was worth it. At least it doesn't hurt to try.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Timeline

It's been 58 days since his biometrics and 91 days since they received the AOS package. Based on those averages you've linked, we're outside all of the timelines unless I've mistaken something.

You probably would have approval by now but the RFE stalled your process. All you can do is wait. Hopefully the RFE is been looked at and reviewed and the EAD released soon.

If you haven't already put in a service request. You can do it after day 75 of EAD processing time. I put one in on day 82, and it was approved two days later and I had the card 5 days after that. It could of been a fluke but it cannot hurt to try. You can do it over the phone or online at the USCIS website.

That 11-12 days that the RFE took should be added to the 90-day processing time. It's a toss-up, but you should probably try for the expedite with a job offer letter like it was explained above by Ksenia_O.

We called and put in a service request for the case. The next day I checked the website and they had sent us the interview notice for the AOS, and then a couple days later, they approved his EAD.

Feb. 21st, 2014 - The message that started it all, on OkCupid

March 2nd-3rd, 2014 - He asked me to be his 

May 7th, 2014 - First met in person (in Ireland) 

May 25th, 2014 - First actual long distance date

Oct 8th, 2014 - Second in person visit (in Washington)

Oct 31st, 2014 - First holiday spent together

March 16th, 2015 - He Proposed!!

April 15th, 2015 - Sent the K1 visa packet to Texas

April 18th, 2015 - CVS received our petition

May 28th, 2015 - Request for Evidence...

June 8th, 2015 - RFE received

June 12th, 2015 – K-1 APPROVED!!

July 16th, 2015 - Consulate received package and we received our Packet 3

Aug 11th, 2015 - Packet 3 emailed back

Aug 25th, 2015 - Still haven't received anything back from the embassy, Packet 3 emailed again

Aug 26th, 2015 - Packet 4 received, our interview is set for September 15th!!

Sept 15th, 2015 - APPROVED!

May 3rd, 2018 - Mailed I-751 (forgot to include payment though!  )

May 4th, 2018 - Tracking indicates package received at CSC. Also mailed out the payment that was forgotten.

May 5th, 2018 - Tracking indicates payment package received at CSC.

May 11th, 2018 – Visa expired...

June 9th, 2018 - Packet returned... didn't check a box in one section, and didn't include a photocopy of my husband's permanent resident card.
