Still waiting for employment authorization I-765 from Dec 14. 2015

We filed for my husband's I765 back on December 14, with NOA on December 16. According to VJ forms from January are already being processed. I thought it might be the holidays causing the delay but now it's starting to get worrisome. We did get a RFE for the AOS but that's unrelated, right? Any ideas? Thank you.

The I-765 is associated with the AOS, so if you had an RFE for the AOS, it does put your I-765 on hold until your response to the RFE is received and accepted. Then it can take up to 90 days (as in my own case) or as little as a few days for your officer to retouch your case. It's really just up to the Officer at this point.

Some people are waiting over 90 days lately though, even without an RFE.

It seems that some EAD's are effected by AOS RFE and some don't.

December is full of holidays so that has probably also slowed down the process.

We had an RFE for our I-485 and it added time to our EAD and AP

You can see the details in our timeline but it took a bit more than three months. That's also partly because we didn't respond right away to the RFE as it was delayed in the Christmas mail. You could call and check. I found the agents to be really nice. I remember how awful it was with the I129F but they've been fantastic with this stage.

Hello,this with regards to the topic if I 485 is related to I 765.I got an RFE Last Feb .23 and responded 2nd week of March.I got an update yesterday that with my 1 765 it says case approved.But my I 485 still says we received your docs May 21.Could it be that they will give your EAD even if your RFE for I 485 is on going?I posted on separate thread about my RFE.

They received tour RFE response and then continued with your EAD processing. But yes, some people seem to get the EAD/AP without delay even when getting an RFE.

Thank you, everyone! Seems like we are back on track. They did hold it up for the RFE they told us. Of course, it would have been helpful if they told me that when they sent the RFE or when I called and specifically asked them that question - they replied "no, they are separate". Anyway... thanks for the help!
