Filing Forms I-765 and I-131 with Form I-485

Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms together. If you choose instead to file Form I-765 and/or Form I-131 separately after July 30, 2007, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of that you filed a Form I-485.

If you filed your Form I-485 before July 30, 2007, you must pay the fees associated with Forms I-765 and/or I-131 when you file them.

yes i did read that one already, it says I-131 tho, and not I-130. i file I-130 not I-131 or is it the same ? im not sure if it is but i could be wrong.

I get the fact about incorrect fees. That's what topic she mentioned anyway but I am just confused on her status at first.

It's a different process, not the one you went through. If a person enters legally on most visas and is married to a USC they can file for Adjustment of Status, so they can simply apply for a Green Card without leaving the country. This is what OP is doing.

yes i did read that one already, it says I-131 tho, and not I-130. i file I-130 not I-131 or is it the same ? im not sure if it is but i could be wrong.

You are mis-reading the text.

The text is telling you, that when you file an I-485, the filing fees for I-131 and I-785 are waived.

I-131 is your Advanced Parole document, this allows you to leave and return to the country before your GC is provided.

I-785 is your employment authorization document, when approved this allows you to get a job.

Both of these documents when filed by themselves have fees. But if you file them with an I-485 they are free no fee, zip, zero, nada.

i called the customer service center already and this time the rep said 2 separate check each for I-130 and I-485 and yes the I-765 would be free so yaay

one more question. the package that i sent has been dismantled by them, and they stapled the supporting evidence into several parts. should i re arrange everything or just leave it as it is?

Keep it as it is and write a letter with it and that's what I did explaining why it's stapled this way etc

hi there!

i hope someone can give me some advice on this, its stressing me out :cry:

so i send in my AOS package and it got rejected, the NOA said that the payment amount is incorrect or has not been provided.

i got 3 NOA for each I-485, I-130, and I-765. i did check again and again and i put the right amount to pay. which is $1.870.

my guess would be because i made all payment for those 3 forms in one check. but before i send them in, i call their customer service center and ask and make sure whether i have to do 3 separate check or 1 compile check and the rep said 1 check would be fine because its going to be addressed to 1 single name which is U.S. Department of Homeland Security. i put a memo also on the check stating that the amount stated is for I-485, I-130, and I-765.

so im not sure what happened, going to call em tomorrow, but i still need some input or insight for all of you just to put my mind at ease.

Sis the fee is 1,070. AOS is 1,070 and the EAD and AP is free.

Please don't confuse the OP.

OP is NOT adjusting from K-1, but from a tourist visa, therefore OP needs to file an I-130 ($420) with the I-485 ($1070) for a total of $1490, the other forms are free when filed with an I-485, you are correct about that part.
