So finally we got the EAD and Travel approved but nothing about the AOS actually ahead of schedule. Again my concern is I am leaving out of the country for 3 months. How long from the EAD until AOS interview. Is it possible that it wont be until I get back July 1st?

No way of knowing. You may not even get an interview. If you do, then make sure you come back for it with both parties ready for it. Your USCIS case status should change if/when the interview is scheduled, but there has been a few cases of that not happening and an interview being scheduled. That may be rather rare, though.

Thanks, I would not be able to come back for it but rather I would have to reschedule it. I did call USCIS and they said if they needed an interview I could call and they would help me reschedule it.

I hope I am one of the cases that does not need one.. Ive had 2 already:)

Depends, but you could usually expect to wait a few more months or less. Fortunately, we did not have to do an interview, and they granted us the conditional green card.

Jan 13 2016: Sent in RFE evidence ( birth certificate copy .... again O_o )

Jan 19 2016: Received notice that they received the RFE evidence

Feb 22 2016: Called and found out another RFE was being sent out about birth certificate

Feb 24 2016: Sent in (inextensa versions, not de acta versions) of birth certificates for all children

Mar 02 2016: Received notice that they received the RFE evidence

Mar 11 2016: NVC Process finished, now awaiting interview time slot to be scheduled

Mar 29 2016: Called NVC and found out today they scheduled interview

Apr 01 2016: Received Packet 4 notice via e-mail with interview date

Apr 25 2016: Children received P4 letters in the mail

May 19 2016: Interview

Jun 03 2016: Received Visas

Jul 06 2016: Travel to US

If you were getting an interview, you would have heard by now. All you can do is wait. The AOS is processed differently, so you can possibly get it in one year. Dont stress, he can work, and you need to worry about other things.

Not necessarily. The AOS interview can be scheduled long after the first three months of filing.

Not necessarily. The AOS interview can be scheduled long after the first three months of filing.

I am not worried about the interview per say just the timing of it. If its long after then I will be back in time. But from what I have seen with the October filers is that they got approved about a week after they got their EAD approval. hoping to be along those lines too:)

There seems to be a lack of consistency with regards to AOS from K1. Some get interviews, some don't. Some get issued a green card very quickly, others wait over a year. USCIS recommend that you check your local office processing times to see how long you can expect to wait, but even that shows a lack of consistency.

I'm in a similar boat in that I need to go back to the UK for a while to tie up a lot of loose ends and also to arrange my belongings to be shipped over here. But I don't want to book a flight in advance and then find I am called up for interview while I am out of the country. When flying economy, I can't change travel dates and it's expensive to have to rebook.

Also, be very, very careful about trying to re-schedule an AOS interview (if you are called up for one). Apparently that can cause huge problems and potential denial. There was a thread on VJ where someone cancelled theirs and tried to re-schedule the interview, they then faced so many problems as a result. Basically, USCIS only accept rescheduling for things such as family emergencies, serious illness etc., and you would have to be able to prove this to them when trying to reschedule. If you just happen to be out of the country for any non serious reason when your interview is scheduled, then I think they may consider your application as abandoned.

Others may be able to advise also, but the consensus I've seen so far is not to cancel and try and reschedule the AOS interview unless absolutely necessary, and then only with provable valid reasons.

Thank you for your answer. I have no choice but to reschedule and if keeping my job is not a valid reason... then I don't know what is. I am not going for vacation. I was selected to go start up another part of my company which has and always will be a part of my job responsibilities. I know it is ultimately up to them but I do have a copy of my job contract and description. I have called and spoke with USCIS and she said I would be fine and that if I needed to reschedule to call them back and they would help me reschedule. Yes I agree the inconstancy is outrageous. I have gotten through most of their hurdles not easily but accomplished so I hope I can get over this one too. It appears mine is being processed in Lee Summit Missouri. That's not local, I am in Arizona:)

They all start at Lee's Summit-National Benefits Center. If you get approved without an interview, it won't get transferred. If you get an interview, you won't know about the transfer until your interview is scheduled. Our status never changed to "Ready for Interview".

I feel your frustration, but there doesn't seem to be consistent information with regards to cancelling/ rescheduling the AOS interview, including from USCIS themselves. Search for "AOS denied" on VJ, and quite often it's due to non attendance and/ or the applicant cancelling their AOS interview.

I wish there was a way that we could get a clearer answer on whether rescheduling can be done without causing potential problems and possible AOS denials.
