RFE for Affidavit of Support HELP

Hi ya'll.

Just received an RFE for I-485 regarding our I-864 Affidavit of Support.

The RFE is because we stupidly left a box empty which is on Page 3, part 4. It asked for my husband (petitioners) full name.... We had filled everything else correctly.

So now, we will send the affidavit of support all filled out again, making sure the part missing is filled out. Now I guess its just standard procedure to re-send them all the evidence? (W2, IRS Tax Transcript, letter of employment, paystubs etc) even though we had sent this in the initial packet????

Sidenote: My husband was laid off from when we send off our AOS packet and to now (he got laid off March 1st). Now it is March 24, and he has been offered a new job doing the same thing with a competitor company. He was just offered the job Tuesday, and they are yet to send us his contract to sign.... We do not know when his start date is either.

I have 88 days to send it my RFE evidence.

My question is: Do we go ahead and still send his old employment letter and keep everything as it was?

Or do I wait till his new job starts, wait for those paystubs?? The only thing Im worried about, is that if we wait - the new returns are expected to be filed April 15 for refunds and who knows when I will be able to get the IRS to send us the 2015 Tax transcripts... I assume the once it hits April 15, the USCIS will expect the MOST RECENT IRS Transcript.

What does the letter for the RFE say? We also got one for the Affidavit of Support for an expired form. We read the instructions and it very specifically asked for the new form. So we completed the new form and sent that in with the letter they sent us, as instructed. We did not re-send any supporting documents because they were not requested. That was last year. They updated our case to say they received our response, but we are still waiting to hear anything further. I would think that if your evidence submitted at the time of filing was all complete at the time, it's fine. Was any of the information on your new form different? If so, I'd probably send in supporting documents to back up any fields completed that are different to what was on the initial form you sent. I hope that helps.

Well as above ^ my husband has been offered a new job... but we are unsure of his start date yet so I am not sure whether to just send in the old evidence info (letter from employer, paystub)

Also, I don't understand what they mean about a joint sponsor?? Because my husband is THE ONLY sponsor. But I really think its because page one of the affidavit says my husbands name, then page 3 when it asked for his full name, we forgot to fill that in.

Sometimes I think they just have general RFE's that they send to everyone since people get RFE's for such similar things. I would disregard the second part on the RFE since you didn't have a joint sponsor. I would send them EXACTLY what they asked for in the form, meaning you should submit the new revised I-864 including the W-2's + return or tax transcripts that you sent in the original packet. For the paystubs, include the months up until your husband was laid off. I would attach the offer letter for the new job and an explanation stating that your husband has found a new job and will make x amount of money. I would also include the 2015 tax return and evidence, as I've seen many filers get RFE's for this, even though we have one month until April. DO NOT wait until your husband is well into working to send your RFE. Your case is stuck in limbo until you address that RFE and it's already delayed because of it--you don't want to wait and delay it even more.

I got the same exact RFE because I also forgot to fill the name. I only sent in the revised I-864.

I did not re-send the tax returns since they were so big and nothing has changed since we sent it (2014 ones).

Hopefully they accept what I sent. Please let me know what you sent. Thanks.

I got this exact same RFE! Except we did fill out Page 3 part 4. I have copies of what we sent and it was without a doubt filled out. Also we never had a joint sponsor!
My husband is self employed and currently working on a personal project so I'm going to use this opportunity to send a joint sponsor just in case it becomes an issue later.
Let me know what you guys end up sending? I am planning to respond to it on Friday or Monday. Need to get the joint sponsor paperwork ready.

I just ignored the joint sponsor part and re-sent the correctly filled I-864.

I assumed that because I had left part 4 blank, it generated the joint sponsor part.

They already received my response, so I'll let you know what they say.

By the way I really did leave a part blank, it was at the bottom of the page where they ask for the name. I don't understand why they would send it when you filled it out correctly.

On second thought, better be safe than sorry, I would send it everything you have, including tax returns/transcripts.

If you can, I guess it can't hurt to send a joint sponsor form.

When I was filling out the i864 again, I realized something VERY IMPORTANT. When you fill out Page 3, part 4, it automatically fills out the name on Page 12 part 11 Additional information. If you delete the name in additional information, it will delete the name in Page 3, part 4. Please keep this in mind when filling out the form. I think a lot of people, including myself may have reached the end of the form and deleted the name in additional info so as not to confuse the uscis officer, not realizing it deletes the form in part 4. Hope it helps anyone reading this.

Do you have any update on your case? We did the same thing we used the expired form. The RFE says, The version submitted was no longer valid. Even though it was a week passed the beginning of the new version. So, now resubmitting it with the new form, also without the supporting documents. I hope it's okay.

I am abou to submit my RFE as from my original post. With the updated I-864 Affidavit... do I need to send in my husbands copy of passport again to prove his citizenship or just the updated form with tax documents??

I did not submit my husband's proof of citizenship, however, if you feel nervous about it and it's easy enough to include, I would just include a photocopy of his biographic page. But I believe they do not ask for it from your spouse. If you have a joint sponsor, definitely include the joint sponsor's proof. I used my aunt as a joint sponsor and sent a copy of her naturalization certificate as well as passport biographic page.

Anyone who had the same experience on this forum post with the same RFE sent their RFE response and have had a response from USCIS??

Just wanting to know how long it took for your approval/response since sending in your RFE response?
