Hi medicalguy,

I wonder if you know how the DoS issues recommendation or what additional evidence it requests if the sponsor is international organization managed by a philanthropist and the person is subject because of the skill list? My waiver is based on my USC child due to the medical condition and poor health system in the country. Thanks in advance.

Hi guys! I applied for the J1 visa waiver back in November. No response so far, just that they have received my case. Can anyone share their recent timeline? Has anyone gotten a response recently?

Hi Googie, do you have any updates on your case? Can you please share your timeline here?

Hi Googie, I applied in December and the only status change happened was that "USPS returned my document to USCIS"!! Initally I was not sure what is that document however it turned out it is my lawyer's copy of the receipt. We requested to resend it and corrected his address, however again last month they updated the status that my document was returned again to USCIS!!!! No other progress! I checked teir website, and it seems that they have a delay in processing I-612. Currenly they last completed waiver was received on 9/2015!!!

Did you get any updates so far?

Hello all,

I applied for j-1 hardship waiver in December based on heath condition and hardship to USC child and bad conditions in my home country. The status on USCIS and DOS websites has not changed since time of application.

Googie: how did you learn "USCIS just requested non advisory opinion April 8th." - did this appear on USCIS website?

anyone please guide: at what point should my lawyer or I should contact USCIS for update on status?

It takes USCIS four months to make decisions on hardship. I received the update from USCIS after 4 months. If yours is beyond the USCIS processing time then you or lawyer can contact USCIS about it. USCIS posts any updates on the website under your receipt number or text messages if you chose the option.

Hi all, USCIS just requested non advisory opinion April 8th. So i hope this process can end soon.

Great news!! Thanks for the update!

So it took them almost 5 months for you to send for non-advisory opinion from DOS! Hopefully they will send mine by next month!! Usually It takes a 1-2 months after sending I-613 to DOS before getting favorable recommendation.. I hope you will here from them very soon!

I'll keep every one posted regarding my timeline...

Hi guys,

USCIS requested non-advisory opinion on April 11th!! I applied for the waiver on dec 18th. So this is less than 4 months. Phew!

Please some one share what does this mean?? Does it mean they have forwarded the application to USCIS?

That can be considered as good news, at least this mean that USCIS are seeing evidence of hardship in your case and they forwarded to DOS for non-advisory opinion. Now, DOS has to review your waiver case, and usually it takes 1-2 months (might be longer), and then if they find an appropriate waiver case, they return your case back to USCIS with favorable recommendation, who makes the final decision within a couple of weeks. Usually when DOS gives favorable, USCIS would approve your application. Make sure that your ford DS3035 is already sent to DOS so they can proceed with your waiver application.

Hope you hear good news soon!

It only took USCIS 4-5 weeks in my case to ask for a non-uscis advisory opinion, but took DOS about 3 months. Not sure what has changed recently or if my case was a fluke.

I heated the same last year but currently there is a lag in the I-612 cases at USCIS, their processing times at CSC website was last updated on 4/12 and still the last case processed was the one received on 9/16/2015. I hope they are catching up right now cause my case is still pending initial review at USCIS!!
