Hello All,

We are petitioning the daughter (age 13) of my wife's mother. The petitioner is my Mother-in-Law (MIL) who is a LPR and arrived in USA May 2015. We have paid all the fees and PD is July 2016 for the daughter/sister.

I am confused about Section 6 & 7 of the I-864 for MIL. Since the MIL doesn't work and has no income my wife and I are co-sponsoring, so we will be doing a I-864A. On Page 5 of section 6 on the I-864 it asks us to list our incomes and we have done that.

However, when you get to page 6, same section 6 it starts asking about filing taxes and assets. Are they looking for us as co-sponsors info, or just my MIL? Obviously my MIL has not filed taxes or has any assets so I am confused. Why have two forms if they seems to be gathering all the information on one?

It seems like the I-864 is her info, and the I -864A would be our info, yet they seem to combine it on the I-864? We have filed taxes the last three years but my MIL could not have just arriving last year. What are they looking for? Should I just complete all financial data using our numbers?

Very confusing these forms.

you are confused, you are joint sponsoring, you aren't petitioning your sister in law

the primary sponsor is your mother in law, as the petitioner she MUST fill out an i864 and mark I am the petitioner, even if she makes $0 income and attach a letter explaining why she doesn't require to file taxes

your wife will be her joint sponsor and you will be her co sponsor. she will fill out another i864 as the only joint sponsor and you will fill out the i864A as her household member, so you don't put anything on your MIL's i864

whoever does the i864, the cosponsor filing the i864A, will put his or her income on the i864 of the spouse

Thank you very much for your response. I am confused for sure. I get it that the I864 is about the MIL, all that is zero, why then do they ask for "other household members" and want that info on the I864? Makes no sense to me when we have the I864a?

You are correct, and I know, I am not the petitioner, I just need to know what forms/info we need to submit on the I864 & I864A? Seems like these forms are separate--for separate people, but when does the combining stop or does it not?

Right now we are filling out I-864As for both me and my wife--separate, to support the I-864 for the MIL who has no income.

What are we doing wrong?

nope, she doesn't have any income, so you aren't combining anything with your mother in law

you are combing with your wife, so one of you will be the joint sponsor and fill out a second i864 and the other will combine income with spouse and file the i864A

you combine with each other, your mother in law will file a separate i864 as sponsor
