Hey all,

I have been reading your awesome posts when I first applied my permanent resident card 2 years ago. My green card is thru marriage. Long story short, life went by and I completely forgot that I had to apply to remove the conditions and apparently I have 29 days left to apply. Thankfully a police officer pulled me over for something minor and he reminded me the expiration date on the DL, that's how I remembered this process. I'm not the best person in general when it comes to this kind of stuff but in green card, I almost did everything incorrectly in the manner of keeping records & etc.

I also moved out of the house that I filed and I didn't even think of updating the USCIS about that. I'm just hoping it won't cause any problem in this process.

My first application is submitted by my lawyer & he was there for the interview as well. For this one I really don't want to pay 2500 dollars plus expenses and fees again if it's just about filling the form and submitting it with valid evidence. My wife & I were filing taxes joint, we have credit cards, bank accounts, mortgage, a motorcycle loan, car & homeowner insurance, cell phone plan, shopping club accounts (actually only one which is COSTCO) and possibly some other stuff that I can't think of, that we have both our names on contracts. I also have my good standing employment verification that I could obtain in such a short notice.

Now I have a couple points that makes me really confused.

I went through the I-751 just now and I don't know if I have a Uscis-elis number. Even if my lawyer submitted the fee through there, I received no e-mails saying anything related to ELIS. (I really don't want to hit him up for this as I personally know him and I'd feel like I owe him an explanation about me filing it personally but if it comes to that, I will.) I'm pretty confident that we sent the checks with the mail and didn't use the online system to pay for application.

So:

- Would it be a really big of a deal if I leave it blank as I really have no idea if I even have elis?

- Am I really late to file?

- Considering the list I provided above, do you guys think we have sufficient evidence?

I know it doesn't seem really splendid but I'm hoping you guys can address me in the correct direction.

- Am I really late to file? Do you currently have 29 days left? Why do you consider this to be too late?

- Considering the list I provided above, do you guys think we have sufficient evidence? I am leaning toward yes.

I know it doesn't seem really splendid but I'm hoping you guys can address me in the correct direction.

Thank you guys for the answers. I will leave ELIS blank and send my completed application on Monday.

What do you think about the affidavits? Do they have to be notarized or do I "have" to have them at all?

I left it empty actually. If you have time, I can update you soon. I'll be sending my application in 2 days.

I read your first posting. You basically lost two months in filing your petition but you are fine as long as you do not pass the expiration date of your conditional residency. Your evidences are generally good, but I'd also suggest:

- IRS tax return transcripts. Can be ordered online, arrives in a week or so. (you could also go to an IRS office and have them printed there but remember it's tax season, expect crazy long lines).

- Health insurance enrollments

- 401K beneficiary assignments

- Copies of driver's licenses showing same address

- Photos

- Travel itineraries

- Christmas cards/other mails addressed to both of you

- Affidavits

And as others say try to cover the last two years, not just the recent months. Even the smallest detail would count, so don't ask if something would be appropriate. If you think a document is addressed to both of you, just send it.

Let me know if you have any other questions but I must say I am not approved yet either.

You aren't too late at all.

My package was signed for at Vermont 3 days before expiry of my card, and if I hadn't paid the extra for fedex next day it would have arrived on the day of expiry. As long as it is there before then, you are fine.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Hey guys,

Thank you for the encouragement and sorry about the late reply. I'm waiting it to finally come to an end so I could post a better update. I have filed and sent my application already and it's delivered on 14th of April. I still haven't heard yet. I have more details about errors I made that I will post in here that I'm pretty sure it'll be informative for people such as I am who tend to be not too careful on their processes & paperwork.
