case is outside processing time

Hello,

I applied for my husband via I-130 and received NOA1 on October 23, 2015 at CSC. On November 9, 2015, I got a transfer notice that it has been transferred to Potomac Service Center. It stated online update that "On November 9, 2015,We transferred your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan, to another USCIS office that now has jurisdiction over your case." I received another update online on December 2, 2015 that "my case was received at my local office. On December 2, 2015, we received your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan, Receipt Number **********, at your local office. If you move, go to www.uscis.gov/addresschange to give us your new mailing address." and then I received another online status on March 13, 2016 that ""my case was received at my local office. On March 13, 2016, we received your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan, Receipt Number **********, at your local office. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. "

The next steps stated are "We will prepare your case for officer review. If we need more information, we will notify you."

Its been exactly 5 months since NOA1. I called USCIS today and I was told that since it has been transferred to local office, so I should make an infopass appointment with local office and he said that he cannot open up service inquiry request since it is still under time frame. I called uscis again and talked to different representative; she tried to open up service inquiry request, but she got a message that ''its still under processing time since CSC is currently processing a file of October 7, 2015" so, I should wait for another month and then call again. I don't know what next step should I take? Should I schedule an appointment with infopass? or write a letter to local rep of senator.

It took me 5-6 months before approval, so hang in there. If they need something else, they will send you a notice. For this process, there is a certain time frame that they ask you to wait (5 months) but sometimes it takes longer... so you have to wait. I would call every week instead of waiting until another month and try to make an inquiry, You never know, they may actually complete your approval. I don't think we are at the "write your senator" level yet ... you just broke the 5 month time period which is the normal time frame.

Also, it seems that they are backed up and processing files that had their NOA1 on Oct 7 ... and yours is Oct 23, so that is why she said to wait another month so that it will give them time to whittle it down to the Oct 23 area.

I hate to tell you this, but you might be in line for petitioner interview at your local office. Same thing happened to us. I-130 was sent to Texas Service Center. About 2 months later we got a transfer notice. I later called and found out it was transferred to the local office and the USCIS representative suggested I make an InfoPass appointment. I did and found out it was going to be scheduled for interview.

On the good side, the interview took only 10 minutes and we got an approval but it took an additional 5 months to get it scheduled. :/ So we waited 10 months for NOA2.

I hope that's not the case with you but scheduling an appointment would tell you for sure.

well, I just received an email that "On March 23, 2016, we approved your Form I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, Receipt Number ********. We will mail your approval notice. Please follow the instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. "

so it took exactly 5 months for them to do it
