I have a few questions, I'm really trying to avoid RFEs!

a) I have black and white copies of the passport does this matter?

b) How strict are they on the passport photo rules?

c) Is it enough to have the tax information from 2014, my sponsor hasn't filed for 2015 yet?

d) Anything else I should add/ take out

What is a SEVIS confirmation and why did you send a transcript? Is it the latest transcript? Why did you send I-20?

a) Black and white copies dont matter. Just bring originals on the interview

c) I would say have them file for 2015 so you do not get any RFE. (Who is your sponsor?)

How long have you been married and is there any other evidence of Bona fide marriage you can include?

How long have you been married and is there any other evidence of Bona fide marriage you can include?

Married since 12/12/15. included

  • Photos

  • Copy of lease

  • Copy of proof of joint bank account

  • Copy of insurance policy

My sponsor is my uncle as my wife doesn't make nearly enough. Does she still have to fill the I-864? She's only filed taxes for the past 2 years, but we're talking <6k$

Your Proofs look good for the length of marriage. Maybe you can get a joint credit card if possible. Your wife does not make much so your uncle will fill I-864. Make sure that he files his 2015 taxes. By the time interview is scheduled it would be after April 15 and they would need you to have his 2015 Returns. They may also send you an RFE for that before the interview.

So she doesn't need to fill an I-864 at all?

My sponsor said he will be filing for extension this year so I don't think this is an option

No. She is not your sponsor anymore. She is just your petitioner. Your sponsor is your uncle.

A lot of other people are saying the petitioner needs to fill the I-864 regardless

hi

of course, the petitioner is always the primary sponsor and MUST file the i864, even if she had $0 income, the uncle will be the joint sponsor

and will file another i864
