Hello!

Just recently engaged. And we are starting filling up the forms. My US fiance' sponsor has 1 DUI before.

In page 5 of Form I-129F ,

2. c three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.

My fiance' answer is NO , on that question

Does he still needs to show court documents history/police history with his 1 DUI before???

Please help me i need more information.

What about form I129-F? In Part 3 question 4.a. specifically asks: "Have you ever been arrested, cited, charged, indicted, convicted, fined, or imprisoned for breaking or violating any law or ordinance in any country, excluding traffic violations (unless a traffic violation was alcohol - or drug - related or involved a fine of $500 or more)?"

Is this new?

My partner had one DUI and we put yes and sent in the court documents.

 

I am so confused.  Is the OP filling out an old form?

I don't have the court documents (the lawyer never handled those to me 11ys ago) and I'm trying to post the K1 package asap since I'm currently in the States on holiday. I added an attachment and explained the whole DUI case (happened in Italy) but I don't have documentation/proofs, will they require a RFE or even worse reject my request? Does a waiver require much more time (and money) if I'll have to do that?

Now they changed the form and needs to declares DUI. My fiance had a DUI year 2012. We are January 2017 Filer and we fill out old form and we didnt have to declare that under the yes and no question but we stated it in the attachment explaining how we met and why it took him three years to come in my country. Now we are waiting for the inteview result this month. I myself is concerned about this now what if the CO ask why we did not include it ayeyayayay
