Expedite request for EAD

Hi guys,

I am AOS from F-1 status. I submitted my application on November, and received NOA on November 26. I had my biometrics on December, then received an RFE on Feb 2 for initial document. I then responsed to RFE on Feb 27, and received "Response to RFE" notification change online on March 2.

After that, I have submitted an expedite request because I was working on OPT until December 31, then been on leave of absence for 3 months now, waiting to receive EAD so I can get back to work. 5 days after submitting expedite request, USCIS response to me that they haven't received my response to RFE and ask me to do so (I guess the response still in the mail room to be sorted and has not landed on my file yet).

Now it's almost the end of March and I really need EAD to get back to work because I've been on LOA for too long and I'd have to resign from my position if I do not have EAD. Can I submit another expedite request?

On March 2 there was a response to RFE notification online, yet they responded to your expedite request by stating they did not receive your RFE response? Have you replied to that issue? That seems more troubling than your lack of EAD at the moment. It would seem to me you need to take care of the RFE response issue before an expedite can be considered.

Hi, thanks for your response. I have resolved that issue by putting in another service request and they replied to me that my case is still in processing time as they have received my response to RFE on 3/3.

Oh ok. That's good! Well the choice is yours. You could send another expedite request. Worse they can say is no. I would think as long as your RFE response was sufficient you should receive EAD soon tho. Good Luck!
