Resubmitting then1-485 for my K2 stepson (merged threads)

I need help in doing this Adjustment of status request again for my K2 stepson. So he's green card was denied in feb 2016 for not supposely not sending all.documents in which we did for more proof mind you all he's dad was given his green card in october 2015. I decided to resubmitt everything again! What should I send out first? We re did the.immigration exam Please help thanks

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Does my 6yr old stepson A K2 does he needs to file a I-765? He came at the same time with his dad a k1 and he already got his green card. We now filing his paperwork again

Jul 14 2014: CEAC updated but still READY Status

Jul 16 2014: CEAC Status changed to Administrative Processing

Aug 06 2014: U.S. Arrival (Ft. Lauderdale POE)

Timeline

File everything that is required. Basically the same things are required for a K-2 as the K-1. Check the instructions. The EAD will allow the K-2 child to get an SSN. File for the EAD and AP for them, as they are free.

Do I need a new I864 that was accepted for his K1 dad that got approved in October? Or xan I just send them a copy? I decided to re- do my step son's k2 for a AOS is it mandatory to apply for a EAD HE's only 6yrs old

Yes file for the EAD without it you will not be able to get him his SSC till he gets the GC and that can take awhile.

They reapply and follow instructions exactly, do not leave anything out. If I knew what was sent, or what they said was missing, maybe I could provide better insight.

ALSO, make sure you COMPLETE the entire application forms. Missing data in the application forms will almost certainly get you denied again.

If you are reapplying, re-do all of your paperwork. It's best to start fresh, in case you missed anything.

The child is immigrating with you/within 6 months of you, so if they were listed as a family member in Part 3 on your I-864, then I would include a copy of it with a statement about it being the I-864 used for the K-1 parent's adjustment application that was originally filed concurrently with the K-2 child's application. Include the I-864 supporting documents too, recent tax return/transcript, and proof of current income.

No, the EAD is not a requirement for anyone, but the EAD is a way for your child to apply for a social security number, and they will have a US govt. ID that way too. The AP is free too, so why not just do both? What if something happened and you needed to leave the US and take the child with you? They would need the AP to return to the US while waiting for their green card to be approved.
