Timeline

Hi there,

I'll enter California with the K1 from Austria beginning of April and will get married end of April and then righ away file for EAD, AOS and AP.

When do you think I will get the Advance Parole and the EAD? Will I get them at the same time? Or what comes normally first? If it helps for the answer, I will file from San Francisco.

Typically no sooner than 60 days after you apply for the EAD or AP, but around the 90 day mark usually. Sometimes the AP comes 1st, but none of this is for certain. I would say between 60-90 days.

June 1/06 - Moved to CSC

August 12/06 APPROVED - NOA2!!

June 25/09 Greencard arrives in the mail!

We just sent in our AOS with the EAD. We decided against doing the AP as he doesn't need to leave the US for now. Paying for the EAD application is basically just insurance to get him working asap. We have read from people that the EAD is a waste of money as you get it when your AOS is approved, but there is no way so saying how long that will take.

The AOS takes to my knowledge much longer than the EAD and the AP.

I would plan for a minimum of 90 days, as that's the sort of time the EAD is likely to take, but it could be longer.

But it also depends on how soon you marry & file for AOS. So allow for extra time there.

I haven't worked since arriving in September, so that's nearly 6 months. Hopefully my EAD will be on it's way soon!

01/17/2007 - Email Notice of RFE for I-864

01/23/2007 - RFE received in mail - envelope open!

01/29/2007 - RFE mailed back to MSC

02/02/2007 - RFE received by USCIS & case processing resumed

02/09/2007 - AOS transferred to CSC

02/27/2007 - AOS *Touched* (case now pending at CSC)

03/14/2007 - EAD card production ordered

03/16/2007 - EAD Approval notice sent

03/19/2007 - Received EAD & AP in mail

07/11/2007 - Card Production Ordered! (Green Card on its way!!)

wow, september, that is definitely a long wait.... does that mean you did not even get your ap?

What can people do if they really want to travel outside the country and don't have the ap yet?

In my case it will hopefully not be an emergency, but I have a very sick family member and don't want to wait until the emergency comes, which would be that he passes away? is there any chance to get the ap faster?

Yes, you can get an expedited AP if this emergency comes up. You would make an infopass and show them proof (doc letter, funeral letter, etc) to prove the emergency. Hopefully that doesn't happen though.

My husband filed AOS, EAD, and AP in July 2006. You can see by our timeline what was approved and when. We have been waiting since July 27, 2006 for his Green Card. Unless it is approved soon, we'll be filing to renew his EAD in May or June.

I arrived in September but our wedding wasn't until November 26th & it took us a month after that to file for AOS, so the waiting didn't really begin until the end of December (see my signature).

Obviously if you get married as soon as possible once arriving & file quickly, then you should be able to work about 3-4 months after arriving.

Hopefully my EAD will be on it's way soon!

Looks like I was right. Card production ordered last night, so I can start working soon. Yay! :D

So it took 83 days from filing.
