Try to talk things out with your spouse,If she start cheating on you then it seem you are not doing something right.Since the marriage was done on truth and realness then you have to put it in prayer because most times the spiritual world controls the physical.You need to be prayerful and what God has joined together nobody cud put assunder.

Sorry, where is the abuse? At least from his words, she's not using his immigration status to control, blackmail or extort him in any way.

Her saying that he will be sent packing is the truth. It may not be the nicest thing to say, but I can't imagine this would even come close to qualifying as a VAWA.

I don't think you even read a word I wrote. Maybe you just like to argue. Where did I say it applied to him? I have said in theory and have said the idea of using immigration status to control someone, not once have I said this would apply in his case. If you use immigration status threats in order to control someone, you are abusing them and opening up a possible VAWA path to stay.

I don't think you even read a word I wrote. Maybe you just like to argue. Where did I say it applied to him? I have said in theory and have said the idea of using immigration status to control someone, not once have I said this would apply in his case. If you use immigration status threats in order to control someone, you are abusing them and opening up a possible VAWA path to stay.

Because it could apply to him. He hasn't exactly given the full story. And his options are divorce and go home or if there are grounds adjust status via VAWA. VAWA is not just for people who are beat up by their spouse.

A moment ago you pointed out it did not apply to him. Which is correct, there's absolutely no indication of abuse.

VAWA stands for Violence Against Women Act (Includes men too) lets not rename it "Pretend to be abused so I can get a Green Card act".

I don't think VAWA applies to the OP unless he comes back and post actual abuse. His wife did not use his immigration status to leverage anything. She simply stated she wanted a divorce which is her right. "Sending him packing" to go home is actually factual because without AOS he does have to go back to his country. it wasn't nice, but it was factual.

And I do agree that VAWA gets incorrectly thrown around too much on this forum.

The dude doesn't want to go back! He managed to land a tourist visa and considering where he's from that's pretty huge. Then he came here and tried to stay! If he goes back he'll never get another tourist visa to the US!

Maybe the mods should step in as the insults are flying now. The OP (and others) should know by now that if the wife files for divorce, he has to go back home. No abuse, no AOS, no green card.

No such thing s adjusting status on your own, You might be thinking the Removal of conditions.

but why even put the idea in someone's head when no one said a word about abuse? Seriously??? The guy's wife cheated on him and he wanted to know his options. There is only one. Go home. Cheating is not abuse
