I've been married for almost 9 years, since 2007. I'm a USC,my husband is a green card holder. He received his GC in 12/2011, a ten-year GC. I'm ready to divorce him; I'm so unhappy with him and our marriage is a failed one, and although it hurts, I've accepted it. My concern is his GC status after we divorce. We have a child together. I don't want his GC and/or future citizenship to be affected by the divorce. Will he have issues filing for citizenship? Please tell me if there is a need to be concerned; divorce papers already filed, however not finalized nor signed.

Did you mean to say this? How is it good faith if you say you got married so he could get a Green card. Goodness.

He was eligible to apply for citizenship since 2014. He doesn't you need you to do that. The 5 year rule applies and he no longer needs to be married to a US citizen. So sorry it didn't work out.

Yes I'm aware that it's immigration fraud to marry for green card. We've been married for 9 years and we've been to every immigration appointment together, we have a son together. I'm aware yes, but that's not my question.

I'm not sure what your motives are. On one hand you don't want the divorce to affect him. On the other, you just happen to drop in a subsequent post that you committed immigration fraud. Hmmm...

Wow. I didn't commit to immigration fraud, I stated that I know what immigration fraud entails. I assumed I'd get better insight from this website in regards to my situation on this website, but to no avail. Unbelievable, I might as well pay an attorney to get my questions answered and concerns take care of.

Since he has a 10-year green card, the divorce will not affect his green card. If the divorce happens and he decides he wants to apply for citizenship, he can apply for citizenship using the 5-year rule.

Don't worry, what you said doesn't imply any kind of immigration fraud. And your question had nothing to do with fraud anyway.

Marrying someone you don't love or want to be with romantically so they can get a green card is immigration fraud.

What the OP did was marry some they did love and wanted to be with romantically so they could get a green card and be together. That's what "married to get a green card" means here. That's not immigration fraud, calm down.

OP, divorcing makes no difference now. Don't worry about the effects of that on his immigration case.

Yeah, I read the OP's comments the same way. Her alternative to not marrying the guy so that he can get a green card, would be to live with him until his status runs out and he is forced to return home. Marrying him so he can get a green card and they can continue their loving relationship seems like a no brainer to me.

OP I'm sorry your marriage didn't work out, and nobody thinks you committed fraud, so don't even think about that twice. He can apply for citizenship on his own, yes.

Or remain a LRP if that's what he wants. You wouldn't risk that either.
