Hello Guys,i need some help and inputs regarding AOS.My fiancee arrived here last Feb 4 2016 and we agreed not to get married when she come.Just to make sure we really want to pursue our relationship to the next level and that's husband and wife.Now, we have schedule for the wedding next month.She got her SSN last week..My questions are, after married what are the requirements for AOS?can we apply her AED together with the AOS?as i remember her i-94 will expire on may 4..do we have enough time to file for Adjustment of Status?Im bit worried ..if we married next month ..how long the marriage certificate takes.your help and inputs will much appreciated

The date on the I-94 is the date that you must be married by, not the date that you must file AOS by. It is ok to file for adjustment of status after that date, it is just not preferable because during that time your fiancee will be out of status until it is filed.

So if your marriage certificate takes that little bit longer to be ready (mine only took a week), it's ok! Don't panic. You can wait to file AOS when it is available :)

thank you i was just worried when i saw her i 94 will expired on may 4.I heard some of my friends who married with Filipina that they married 1day before the expired date (i 94).We are getting married on April 18.They said their marriage license took 2 weeks.so im bit panic for filing our AOS maybe it will conflict or what ..Now,im gathering all the forms and some requirements.and we will sent it after we got our marriage certificate

Getting your marriage license is either state or county specific (I can't remember). The marriage license must be acquired before you get married. For us we had to wait 72 hours for our license, and then we had to use it within 28 days to get married. Check with the Vital Statistics office where you live, it should be on their website too. It will tell you how many days to wait for the license and how long you have to use it. This for sure will need to be done before the I-94 expires as you cannot get married without it!

The marriage certificate will be picked up after your wedding and a copy of it will have to be submitted with the AOS papers. Again, as long as you are married, you can file whenever it is convenient for you.
