Hi, I was just wondering if anyone knew the answer to this question.

I recently received in the mail a I-797C Notice of action with a rejection notice. however I am rather confused as to what to do, the letter reads as follows.

Recently, you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process this application. If you submitted a G-1450 it has been destroyed and will not be returned to you. Otherwise, your payment is being returned to you with this notice. No additional action by you is required at this time.

Now I have read on some forums about people receiving green slips allowing them to resubmit their application, I received no such slip. On top of that the form has no case number, A number receipt number, or my date of birth. It did return my money order.

I have read that payment for a work permit (I-765) is not required if you are filing for your adjustment of status (I-485) at the same time as your work permit so I was wondering if they are simply returning my payment.

I hope that someone will be able to answer my question as i need to know if i need to resubmit or if this is simply a return of my money.

Looks like you paid the wrong amount which is why it was returned cause for everything you only had to send $1070, even if you give them an extra penny they will send it back as a denial, as for why they didn't give you a green slip I am not sure,I suggest calling USCIS

That's the thing though, the denial was not for my adjustment of status, they happily took the extra ten dollars haha. The rejection was for my work permit which cost $380. My adjustment of status is processing fine.

Your total cost is $1080 for adjustment of status and work permit. You did not need to pay $380 so they are returning it. Normally you would send the adjustment of status and work authorization applications together. You can still get the work authorization free if you send it later by sending a photocopy of your I485 receipt with it to show you have an adjustment application in process. If you didn't do that, I guess they figured it out that it would be no extra charge to you.

"No additional action by you is required at this time. " Believe them.

So it looks like the US is returning the money that you overpaid? That's good news.

USCIS gets a lot of flack on this website but in total we have a very fair, very honest and very transparent immigration system.

You're just going to be getting a refund for the work permit fee. You will want to call and check, make sure you don't need to re file your EAD form because you never can be too careful.

The EAD is free with the AOS pack, simple mistake.

What happened to your case? Did it get send back or did it go through?

We just received the same letter today and are confused since we didn't receive our package back.

It did go through, I received my adjustment of status not long after I received that.
