Hi All,

Please help me if this is all I need for AOS and IV Package. Note: Petitioner is unemployed as of 2016. Do I need 2015 W2 if I gave tax transcript?

AOS package:

Petitioner
AOS bar-coded cover sheet
●Form I-864 (signed and dated)
●2015 Tax Transcript with W2
●Copy of Petitioner US Permanent Resident Card (Green Card I-551) front and back

Co-sponsor (spouse)
AOS bar-coded cover sheet
●Form I-864A (signed and dated)
●2015 Tax Transcript with W2
●Letter of Employment
● 3 months of bi-weekly pay stubs
●Copy of Co-sponsor US Permanent Resident Card (Green Card I-551) front and back

Certified copy of the birth certificate of petitioner (English & Khmer) Petitioner information is not needed. The V s all about the beneficiary

I crossed out the things that weren't needed or asked for. Does the Petitioned and the Joint sponsor lie together? I ask becaude you have I-864A for the joint sponsor. That's only for household members.

The petitioner (wife), does not have income as of 2016. Only the husband work. So, we are using the husband's income. Yes they both live together.

1. Since petitioner has no income, she does need to file I-864?

2. Is the husband file I-864A or I-864?

No you aren't understanding me.

  1. You are the Beneficiary correct?
  2. Your wife is the Petitioner
  3. Your wife doesn't work so you need a joint sponsor
  4. Joint sponsor does not live with your wife correct?
  5. Therefore joint sponsor will be filling out a I-864 not I-864A
  6. If joint sponsors income meets the guidelines for the household plus you than there is no need for his wife to fill out a I-864A
  7. Yes your wife still has to fill-out the I-864 she is your sponsor. For years she didn't file she has to write an explanation why she did not file.

Just to reiterate Your wife is the Sponsor/Petitioner. The person you are using to qualify with is your joint sponsor.

I am an LPR petitioner. I petition my son to live in USA. I do not have income but my husband does, My husband and I live together. We have been a resident of USA for a year now, My husband's income met with I-864p. I will use his income for AOS requirement (income joint sponsor or income co-sponsor, which ever wording they used). Will he file I-864 or I-864A?

U need to file i864 coz u as sponsor and petition, and ur husband file i864A coz u don't have income and need ur husband support u.

NVC signed AOS and IV Package today, Mar 29 2016. How do I know AOS and IV approved?

As I know we will waiting 30 day for day review our case ,if something missing they will send checklist. Hope we don't get one. Or U can check nvc wed if u see on aos show paid to N/A , mean ur case complete.

My parents package reach there 17th March, hope we are get complete case soon. Good luck.
