Hi list,

I am in a strange situation, during my Fiancee's interview visa officer asked my Fiance'e to show a document to prove that she has a custody of her child and my Fiancee was not carying that document at that time so they said her to submit the document and they will send visa's for both of them in mail. Now the situation is she can't find that document and the court only have her divorce decree nothing related to the child's custody so she has to re-open the case to get those documents which could take months to a year.

My Fiance'e is willing to leave the child behind, what is the procedure to get her visa. Is it ok to submit passposrt along with a letter saying she only need visa for herself and to put her child's visa pending for one year to VFS center?.

You only fill out the visa aplication forms for only those who you are applying for at this time (DS156 etc...) If the child is to follow-to-join later then at that time you will submit the DS series of forms......

But she already went throught that, she finished her interview.

Then I guess you need to inform the consulate that you wish to withdraw the pending application for her child and will re-submit when the needed missing documents are available but you do not wish this to delay any further the issuance of her visa.

Now im confuse I am also divorced in my first marriage but the kind of visa we submit is k3 , is there any also possibilities i would be asking that kind of document for my kids in my past marriage ?

does it have to be a court document?

Could she get the childs father to sign an agreement that she has full permission for the child to immigrate with her?

There are other people on this site that have reported doing this successfully.

But your embassy requirements and situation may be different.

i not sure of the best thing to do in your situation. when your K-1 is issued, you will have six months to enter the US.

if you withdraw the application for the K-2, then you will have one year from the date your K-1 was issued to have a

K-2 issued for your child, not just the application submitted.
