SponsorShip requirements for I-864 as a second sponsor asides the petitioner

HELLO Everyone, I must say that this group has been so helpful n resourceful. heres another issue. i have a friend who is married to a us citizen .Her husband doesnt make theaflidavit of support fee. (20,025). inevitably She needs a second sponsor. now my question is , her second sponsor has his 2015 W2, a copy of his Legal stay here ( either us passort or GC) . is there any other document required?? pls HELP.

more so i got this reply from ALEFUL(A VISAJOURNEY MEMBER) hi, if the petitioner is sending the affidavit before April 5th then they will be sending 2014 taxes, 2015 taxes aren't needed until after April April 5th, they will also need paystubs and letter from employer.

Does this mean that if she files before april 5th, she will only need the 2015 W2, proof of legal stay only? Kindly assist with detailed information.

Joint sponsor (not second sponsor) will need to provide the most recent tax return, plus proof of legal status, and evidence of current ongoing income and/or assets.

2015 tax return will be required after April 18th, 2016.

no, as I stated, 2015 taxes aren't needed until after tax season is over which is April 15th, my typo if I put April 5th, it is April 15th the end of tax season

if you file before April 15th, 2014 taxes are needed,

also W2s aren't enough proof, you need paystubs, and if possible employment letter

the more the merrier

if you only send w2s, you probably will get an RFE due to not enough proof

No. You need the entire tax return or tax return transcripts, and proof of current ongoing income.

another question, the tax returns are available but it is a joint tax was filed by him and his spouse. so whose name will be on the i-864 form as joint sponsor sponsor.

secondly, the joint sponsor has changed his job from the last time his taxes was filed. and the form says, state your current employer. what should be done? wont it contradict the 2014 tax return information? also it states that the sponsor should state his annual income. he makes more now from what is on the w2 and tax returns.

anyone with such experience? pls advise

The main tax filer will be on the for 864, and the other person whom he filed taxes with will fill out a form 864a along with the other sponsor. They must accompany one another, those forms, if it's a joint filing.

Just did this, literally two weeks ago.

List his current job. It won't matter, but we sent a month of pay stubs with everything to avoid confusion and so they can see the salary pay rate and calculate it that way as well if needed. Use one week full pay as listed on the stub, multiple by 4, then by 12 to get an annual pay rate estimate...but this only matters if his current income is what qualifies as a sponsor. If his last tax filing made the amount required then just list the AGI from it

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

let me paint the scenario again. my friend is married to a US citizen, she wants to file for AOS. but her husband doesn't make up to the poverty line of $20,025 per annum. so i decided to help her out. but the issue is that i filed my taxes of 2014 with my wife,in the tax return, my wife's name is first on the tax and then mine. and i havent yet filed for 2015. i want to give her my 2014 tax returns and W2, my legal stay GC.. i will also give her my new work place which i started in 2015 and pay stubs of my current job.

note that her husband is her primary sponsor, he has filed the i-864. i want to be her joint sponsor. so in my filling another i-864 as a joint sponsor, whose name will i put? mine or my wife? or my wife has to fil another one. pls help clarify my confusion. a link where i can read it up will help.

Well, who wants to do the sponsoring? Who wants to be responsible for the obligations? That's the sponsor. That's the person whose name goes on the form.

If you want to be the sponsor, and your income by itself is enough for your household size (+ the immigrant) without needing to count your wife's income, then your wife doesn't need to fill out or do anything. It doesn't matter how you file your taxes other than for what you need to attach.

If you want to be the sponsor but your income is not enough, and you want to count your wife's income too, then she will need to fill out I-864A and she will be responsible for the obligations too as long as you are.

thanks for the explanation..

will i need to fill my household size on the form? i have a son. also shown in the tax return. how do i fill that part? and how will my wie fill her own side of that form too?
