Stayed more than 6 months out of US on Green Card

Timeline

After living 4 years in the US but before my husband applied for US citizenship, we decided to spend some time in my husband's home country for the following reasons: we had our second child and wanted to stay home with both children while they are young and it is much less expensive in his home country, his grandmother's health is very poor and we wanted to spend time with her and with his family in general and we wanted our children to feel a strong connection to his come country and learn the language.

We didn't intend for him to stay longer than 6 months and we didn't know about the form to fill out before leaving the US.

Now, we want to go back to the US and worry that he won't be allowed to enter because he was out of the US 9 months while on a Green Card.

We are most likely driving. Do you think that they will let him back into the US?

03/21/2011 - NVC sent to Juárez

(How Juarez received before NVC sent is beyond me. I'm just reporting what I've been told.)

04/11/2011 - Juárez sent Packet 3

04/25/2011 - "Packet 3" arrived to my fiancé's house in Mexico

05/02/2011 - Medical

05/03/2011 - ASC

05/04/2011 - Interview

05/11/2011 - Entered the United States of America for the first time in his life

05/16/2011 - MARRIED!

hi might be questioned at the poe, but they will let him, the problem is if he would have stayed more than a year abroad

9 months is still ok

the reentry permit is only needed if the LPR is staying over a year, but less than 2 years abroad, for less than a year no reentry permit is needed

Worst would be that he would end up in front of an IJ where he would be able to show how he had not abandoned the US as his permanent residency..
