Parents name issue in Birth certificate

Hello all,

I am a new user in this forum and today luckily while googling I landed up here I wish I found this forum long before. I am married to a USC and my spouse filed i-130, which was approved last week now we are waiting for NVC to assign a case number.

My question is regarding parents name in my birth certificate. (Beneficiary’s)

My father (late) changed his surname when I was 10 years old, in all my documents his latest surname appears except in my birth certificate. Similarly in my birth certificate mother’s median name is mentioned but in all of my documents she has my father’s latest surname. In short in my birth certificate both of my parent’s surnames are different than my all documents, I am trying to get my birth certificate reissued with parents later surnames but I am told its gonna take 4-5 months as I live in a different country than where I was born.

Is there anything I can submit to NVC along with the same birth certificate? I.e. a sworn affidavit by a close relative or by my mother? I do have my parents both passport copies (a copy which has the old names and a copy which has the later name).

i cannot comment much on this as i am facing somewhat similar issue , this is what i am gonna do

i am the USC and my spouse has her nickname in front of her real name on her birth certificate ( i know its crazy , who does that )

her father made a notarized affidavit confirming her real name

that's what we are gonna show at NVC plus some additional documents and a detailed explanation

birth certificate + notarized affidavit copy ( from her father ) + baptism certificate from the church ( copy ) + school certificate copy (showing her name ) + a letter with explanation

Does your father have a name change document? Do they still have their marriage certificate?

In my case , my own name in birth certificate is correct. Issue is with the parents name. I do not have my fathers name change document but yes I do have an original 50 years old letter issued by my country's embassy stating that my parents are married (it has the old names same as my birth certificate) will that help?

Sure if you can have a copy of that. Your parents don't have copies of these documents or are they deceased?

Only my father is deceased and my mother doesn't have her surname change document.

Will that be sufficient if I submit the following ;

1. Copy birth certificate and it's translation

2. Copies of my parents passports (before and after names)

3. Copy of the embassy letter stating that my parents were married (names mentioned are the old names)

4. Sworn Affidavit by a close relative or mother

5. Cover letter explaining the issue

How were you able to change your name and used your father's new name at 10 years old if your birth certificate was different? Provide documents to support the name change.

I never change my name, at the age of ten years my first passport was issued in that my fathers new name was mentioned (based on the new name on his passport).

I wouldn't be asking for advise if I had name change proof. If I submit the above documents which I mentioned in earlier post will NVC consider it and that would be enough ?

No one can tell you here if NVC will accept your documents or not. Only NV can asess your docs and decide if they are acceptable. Provide whatever documents that you have to prove that the name in your BC is the same person as the name you are using now. There was a suggestion for you to make an affidavit, do that.

Submit whatever you have and wait for the feedback from NVC. While waiting for that, have your BC change; 4 to 5 months is nothing compared to more inconvenience that you may encounter later on.

Thank you for the response, yes I have decided to submit an affidavit against my fathers name change along with his old and latest passport copies.
