My brother went for interview and the co asked him four questions which he answered correctly all his documents were good but the co said the picture he used for the first entry was not clear and the photo size was not the right size thus can't grant visa

My question is can the Kentucky consular select u without checking your picture size nd quAlity coz his was very clear

What step can he take

Get new passport style photos with the correct size and clarity and submit them. I'm sure that they may have told you what to do and where to submit them. I doubt they just flat out denied you because of bad photos. Take them again (preferably from a competent store or photo taking agency) and submit them. It is a delay, but a delay that is needed.

They didn't tell him to submit actually the Co meant the first picture for the dv lottery entry which I know was the riight size nd clear she said it should have been clear like the one I submitt the intervieW day

Well once a visa is denied, you have 2 options .... apply for a waiver of ineligibility (though only certain cases can apply this way and you must qualify) OR Reapply.

On the same note, he must have told you specifically the reason for denial .... I doubt that the person said "bad photo" and then denied you. He must have thought the 2 photos were not the same person and denied you due to potential fraud or something.

Phd1974, your waiver/reapply answers do not apply to DV.

Gusty, unfortunately the CO can indeed do this. If the photo specs are not met it can be grounds for denial. I have heard of this happening before. Sorry for your brother but it's game over for this one...suggest entering again in Oct:Nov and be sure to follow all rules exactly next time.

There is no filtering of initial entries, other than to disqualify duplicates. There is a basic photo validator but it does not check for every detail, mainly looks at size of photos (but not size of features within them) and pixels, not what it is actually in them in terms of the guidelines given in the entry rules that the photo must meet. A computer program draws the entries, and if you submit a DS260, you get an interview. KCC cannot by law disqualify anyone once they have been notified of selection (they can only disqualify for duplicate entries before selection is announced), so they cannot disqualify even if - and they don't - have someone sitting there physically checking photos on the 100,000 or so selected entries....Only a consular official is able to approve or disqualify entries, during an interview.

At the end of the day, it is up to the entrant to ensure that he or she meets the eligibility criteria, has met the photo requirements, met all the documentation and criminal record requirements, etc. I'm sorry, I can imagine how sad it must be, but it's not KCC's "fault".

You cannot reapply for a diversity visa, and there is no appeal against a consular processing refusal for diversity visas.

Denial for a problem with photos on an entry form *is* a valid reason for denial, anyway.

It is a computer that does the selection not a human. So you can submit a picture of a cat. If it has the right dimension, the system will accept it.

It appears COs at Ghana get pissed off easily at Ghanians, it is understandable.

i am always an advocate of 'investigation" regardless how much i dont like your face

Lottery to many is once in a lifetime opportunity.

imagine the other ghana thread where dude was denied because he did not bring his waec certificate, but a slip.

Here in nigeria, this happens a lot

The US embassy will let you go, provide documents and show it.

they even go as far as sending agents out (even out lagos) to ask questions from people who may know the individuals in question to get facts

before approving or denying them visas.

The moment these COs know their decision is final regarding DV lottery, it may be abused.

Because this is not how the lottery selection and interview process works. And the onus is on the applicant to ensure that all the guidelines are met on the entry form. Sadly the consular officers are indeed very strict in Ghana and Nigeria, due to the very high incidence of fraudulent visa applications they encounter there. This does sadly mean that sometimes innocent people are disadvantaged too.
