Hi all,

I'm trying to get my taxes done and since I'm married now and choosing to file married filing separate, my tax guy says my "non resident alien" Nigerian husband has to have an ITIN and has to physically sign my tax form. He will need ID for the W-7 ITIN. My friend said her Nigerian husband went and got a certified copy of his passport from the embassy to use as his photo ID for the ITIN and mailed it to her. Does anyone know where my husband would go to get his certified copy of his passport...would it be the same place that issued the passport? The Nigerian Embassy in Lagos? And does anyone know about how much the cost of that would be? This is going to take time... so any advice on how any of you did this fast would be appreciated.

I can tell you one thing, Now with tax season, the IRS is taking up to 12 weeks to issue ITIN .

We have been waiting since Feb. 1, and calling, and its is still not processed even with the correct of the H&R Block agent correcting their mistake.

Your tax guy doesn't know what they are talking about. MFS you need no SSN or ITN. However you also can not file electronically you have to file by mail You would wrote NRA where the SSN for husband would be

To get a ITIN at this point when you are almost at interview time is a waste and not what ITIN's are suppose to be for. He would be here by the time you got your ITIN.

File an extension and amend your taxes when he gets here (you have to amend anyway when hubby gets here),

First I want to say, I'm not trying to get the ITIN for nvc or for the interview. Only for taxes. My tax guy did tell me I can't file electronically and it has to be mailed in. If I don't need to get an itin or don't need a soc sec for him, I will look for some instructions on line to show my accountant. Thanks.

I was told i could not get ITIN or EIN without a Ss# for my spouse. And the only way to obtain a SS# is with legal documentation of citizenship.

THIS IS AN INTERESTING QUESTION.

maybe i should amend my taxes as well and file later, its worth a try.

Ps: my spouse went to Ministry of Foreign Affairs or External Affairs for certified authenticity seal or stamp we needed on a document. like you stated with ur case.... may be starting at the passport office can at least direct you in the right direction.

That's what the ITIN is for those who can't obtain a SS#. If you have a SS# there is no need for a ITIN. Mostly everyone who has a spouse abroad just files Married filing separate (MFS). Than when spouse gets here they amend their taxes to Married filing Jointly (MFJ) usually getting some money back.

Just about all Tax preparers are clueless to the process and will misguide folk ad tell them to file single which is a violation of the law. You are married you have to file MFS or MFJ. The only drawn back of filing MFS is you can;t do it electronically.
