Hi All,

So i've just gotten off the phone with USCIS for the second time today.

After advising the second operator that what she'd stated was the opposite to what the previous operator had told me, she begun to spill the whole, we can't help you with your forms etc... and this was followed by a supervisor telling me the same thing.

So i've got about two weeks until the 90 day period prior to expiration kicks off, and I need some assistance with this form.

I am the immigrant aiming to get the conditions removed on my green card.
My wife is a US citizen.

Part 4 of the form states...Information about the US citizen or lawful permanent resident spouse.

My understanding is that this is referring to my wife, correct?

Part 7 of the form states...Petitioner's statement, contact information, acknowledgment of appointment etc etc

My understanding in this case, is that it is again referring to my wife? And that she is the petitioner?

BUT

Then in Part 8 the form states.... Spouse or individual listed in Part 4's statement, contact information, acknowledgment of appointment etc etc

So according to the way i'm reading it, my wife was listed in part 4, therefore will be listed in part 8 also. She is now listed in all 3 parts mentioned.

Can someone please let me know where I am going wrong here?

I apologize for what is likely a very straight forward solution, but unfortunately, i'm not seeing it given that as the immigrant, I figured i'd need to be the one acknowledging the necessity for appointments etc.

All assistance is greatly appreciated.

USCIS does not help you fill out the forms. They have limited manpower and would be stuck all day answering questions.

Part 4: Is your wife the US citizen? Then yes.

Part 7: Think about it. Who is petitioning to remove conditions? Who would it be? The GC holder or the US citizen?

Part 8: Who is the spouse of the person in Part 4. List that person's info here.

Unfortunately the I-751 sample does not match the updated I-751 form on the USCIS website.

I guess where i'm falling down here is in my understanding of who is now the petitioner.

And from what I gather from your response, that is now me, the conditional resident.

That said, you've said that in part 8 I should list the spouse of the person listed in part 4. However, the form states 'Part 8. Spouse's or individual listed in part 4's statement ...' which tells me that it is asking for the same person listed in part 4 rather than the spouse of that person.

Am I still failing to understand?

The person needing to remove conditions is the petitioner. You are now petitioning the USCIS to remove those conditions and give you a 10 year green card. So, the parts that want the petitioner's info is you. Part 4 is your spouse. Part 7 is you. Part 8 is your spouse. The instructions actually tell you part 7 is for the petitioner and part 8 is for the spouse that was listed in part 4.

Yes! Thank you! Autocorrect will need the death of me. It should have read "spouse OR ..." NOT "spouse of". :)
