Need some help about married children

My father in law is a us citizen but wants to bring his son here to the united states. His son is over 21 and is married with 4 kids. The question is that can my father in law just petition his son only or do they have to petition all his family together? thanks

why would he just file for his son? the spouse and children will be listed on his i130, since the son is the beneficiary, but spouses and children under 21 will come as his derivatives? why would he want to split up the family?

depending on the country his is from, the wait is over 10 years for married children, some countries close to 20 years

what country is he from?

He can not???? Are you being sarcastic... But its not about splitting the family asking because dont know which way is the best. Do he petition the son and son have to petition his family one he gets his green or how is it done just asking??

no, that's why the family are the derivatives, his father will petition for all the family, if he doesn't have enough income eared yearly to cover for all the family, he can use one or more joint sponsors,

but that is only needed in more than 10 years

for now the only form needed is the i130, his spouse and children will be listed on the form

it is not worth fling for his son alone and him coming here, he will need joint sponsors as well and the petition for wife and unmarried children under 21 is close to 2 years

why be separated when they can all come at once?

Thanks so much that helps clarify it much better. One last question so you can use more than one co sponsor or joint sponsor? I thought you could only use one co sponsor?

because it is a family, at the nvc stage, he will have to file an i864 for each one,

if he doesn't qualify for all, he can have the same joint sponsor for maybe the beneficiary and spouse for example, and use another joint sponsor for the children

they wouldn't be combining income

You mean an I-864 for all of them.

So if you as the petitioner use one sponsor for 2 people do you only file for those individual on the i864 and the other joint sponsor file for the others on their i864..or do you as the petioner have to list them all under yoyr i864?

The petitioner has to sponsor everyone who is immigrating. Then there can be one or two joint sponsors. If one joint sponsor, then that joint sponsor sponsors everyone. If two joint sponsors, then they can "split up" the immigrants between them. Each immigrant has one joint sponsor.
