**** Moving from CR-1 spousal visa to AOS from Work visa forum *****

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Well, what is your status?

well me and my wife got married, we have a marriage cert. people told me that i can file the I-130 and the AOS together. i'm not sure what to put on that question.

How did you enter the US? (With what visa?) When you entered, you were given a (paper or electronic) I-94, with your status (which should match the visa you used), and the period of stay. If you've stayed past that period of stay, or you have otherwise failed to maintain your status, then you are out of status.

oh it was my bad, I am a U.S Citizen and my wife is a temporary worker in Guam (H2B Visa holder) so for the status she needs to do that I-94?
