No Contract of Lease for Apartment

Hi there, Our interview will be on April 14 and I am currently arranging all evidence that will substantiate our bonafide marriage. But We do not have contract of lease. We are just sharing a room from our room mate. We applied for an apartment but the apartment denied our application. Can we bring the denial letter with us as proof that we really intend to apply for our own place?

Can all our Mails, with our name and address can be evidence that we live in that address? Mails like Hospital Billing of my husband, credit card statement? Uber receipt? Something like that... Or Phone bills under my husbands name with the address?

Where the complex denied you, are you subletting directly from the roommate? If so I'd ask them to do up a document for you showing how long you've lived there, that you pay rent(show this in bank statements, too) and the date that your wife moved in and that you are cohabiting.

Utility bills with both names and the same address will help, too. The more the better.

May 31/15 - Sent AOS/EAD/AP to USCIS

June 4/15 - Email and text notifications they were recieved

June 10/15 - NOA1 for AOS/EAD/AP Dated June 1

June 17/15- Change of address confirmation

June 22/15- Biometrics appointment received

July 1/15- Biometrics appointment done(5 minute appointment, 8 hour round trip drive <_< )

August 5/15 - Change of address submitted for new location

August 8/15 - Mobile/E-mail notifications for approved EAD/AP :)

August 17/15 - Change of address confirmation after calling in

August 17/15 - EAD/AP Combo card mailed out(To the wrong address, and then lost by USPS)

September 3/15 - Contacted USCIS and was told to re-apply with a new application and fees?! Put in a service request online for lost card, and a complaint

September 8/15 - USPS found & returned card to USCIS

September 15/15 - Ombudsman contacted USCIS

September 17/15 - Card mailed back out

September 19/15 - EAD/AP Combo card finally in hand

September 22/15 - NPIW letter received, dated September 9/2015 estimated 6 month wait

October 13-21/15 - Traveled using AP to visit parents & ship the rest of our belongings out west

November 27-30/15 - Traveled using AP

December 28/15- RFE hard copy, waiting on documents from Canada

January 31-February 7/16 - Traveled using AP

February 10/16 - Sent in RFE, delivered Feb 16

April 16/16 - Service request filed, RFE was never updated online

May 12 - Approved email and status update dated May 10. Service request never was assigned or solved, though.

May 14 - Greencard in hand!

Hi there, thanks for the reply... Yes, the complex denied our application for an apartment we received letter from them, that our application was denied. Can I bring that as well to the interview?

When we got denied for apartment, I asked a friend if we can share an apartment with them since tbey have one room available. We gave our room mate cash to pay the rent monthly. How is that?

We do received mails with the same address. Can we bring that? Like, hospital bill, phone bills, etc.

We do have joint savings and checking with our names on it and same address.. In our health insurance application, both names are there with same address, Uber receipts showing the address, credit card statement with our names and address, his 1040A has our name with same address, it is really difficult to gather evidence for same sex couple but we are doing our best to have all what we really need for the interview.

For me it would depend on the reason that you were denied. If it was anything due to financial, I personally wouldn't bring it - as you're supposed to be supporting them, this could be used against you.

Do you have bank statements showing you withdrawing money every month for your rent? If so bring those. Like I said above, get your roommate to do up a letter that you're subletting through him.

Like I said, bring mail addressed to you both. It's always better to have too much instead of not enough. Things that you should 100% bring are your taxes showing you filed married, joint savings and checking, health care plans with you both on them. If you're missing bank statements, go to the bank and ask them to do up a formal letter that says the date you were added to each others accounts. Any paperwork that shows a pension of some sort going to the other person, including wills are awesome to have, too. I'm not sure why this would be more difficult for same sex couples, can you elaborate for me?
