My saga has taken a few more turns, so here is an update. I last wrote here saying my AOS application was denied for failing to attend and interview, but that we hadn't received an interview appointment letter.  Well, since then, I hired a lawyer who was very helpful in speaking with someone at USCIS, and on March 23 they reopened our case and told us that we would receive a new interview date. We were so relieved.

 

Fast forward to today...I just received a letter for a new interview date...for YESTERDAY! I seriously cannot believe this.  The date that the letter was written was 3/23, which was the day that USCIS reopened the case, but the postmark on the envelope is 3/29. That means the letter sat at the USCIS office for 6 days before they posted it on the 29th, and now it is likely that we will receive a denial notice for failing to attend an interview....even though there is no way to attend an interview when you receive the interview notice the day after the interview appointment!!!

 

What a nightmare this has been. I really hope no one else has to go through what we have with their AOS application.

great news!!!!!! the lawyer i am with now is awful, didn't do anything to help but just fill up forms, and he is expensive, and I CAN'T  even speak to him, I have to talk to his Chinese assistant, and don't know what should I do. and my husband and i have been calling the USCIS for our delay 130 case, and the lawyer just don't care about , and every time when they call me is sometime may charge me, ask me to get money ready, they don't care about my case, they might hope my case slow down need more processing, then i can pay him.

Thats crazy because its free when you file with the I-485, we're at the end of the process.. might as well just wait it out, because it takes 3 months and it is valid only a year...

WHAT THE HELL!!!!!!.. I was about to say yayyyyyyyy... then I get to the mail...  this is deliberate behavior, because they usually give you a month's notice. SMH

Tell me about it. How can they send a letter on the 29th for an interview date on the 31st???. I have the postmarked envelope so I'll have to speak with the lawyer to appeal again. I have an infopass already scheduled for April 7th at that office, but I think I'm going to go to the local office first thing on Monday morning and see if I can speak to someone.

My head hurts for you man....

makes me nervous that I would go through the same ... this month will be stressful..

That's crazy what they are doing to your case. I hope everything goes well and schedule your real Interview asap.

Timeline

Guys I have an update (PS this is a long post):

 

I had an infopass appointment last week which I had to cancel (I got appendicitis last Tuesday and had to get emergency surgery - THE WORST!!!!!). Anyway, I managed to get an appointment today at 2:15 by some miracle. I went to the InfoPass appointment, gave them all my receipts/notices and turns out we did get an interview date for MARCH 10!!!!!!! I could not believe it. Obviously we never received anything in the mail. He went upstairs to take a look at our file. Turns out that when they sent the notice they forgot to include our apartment number so it was sent back as undeliverable (#######). They gave me a letter saying they will give me a new interview date--they will add me manually to the system. He said if I'm nervous about the notice getting lost in the mail again to make another appointment in a month (I'm gonna do it in two weeks) to see if any notice has been mailed out and they'll make me a copy of the notice right in the office.

 

Moral of the story please stay on top of your application. There are so many things that could happen. The guy who helped me (who was extremely helpful and nice) said I was lucky to have gone in when I did or I would've gotten my application denied.

When did you apply? I'm well outside of processing times. I'm a February 2016 filer. If you're still within processing times it's hard for them to help you unfortunately.

I am stand-alone 130 filer , our PD is august 2nd, it is out of normal time too. and it stayed in NSC for 6 month, and 2 month ago transferred to new york local office. they don't tell us why we gotta transferred, and what should we except for the next

Guys I have an update (PS this is a long post):

 

I had an infopass appointment last week which I had to cancel (I got appendicitis last Tuesday and had to get emergency surgery - THE WORST!!!!!). Anyway, I managed to get an appointment today at 2:15 by some miracle. I went to the InfoPass appointment, gave them all my receipts/notices and turns out we did get an interview date for MARCH 10!!!!!!! I could not believe it. Obviously we never received anything in the mail. He went upstairs to take a look at our file. Turns out that when they sent the notice they forgot to include our apartment number so it was sent back as undeliverable (#######). They gave me a letter saying they will give me a new interview date--they will add me manually to the system. He said if I'm nervous about the notice getting lost in the mail again to make another appointment in a month (I'm gonna do it in two weeks) to see if any notice has been mailed out and they'll make me a copy of the notice right in the office.

 

Moral of the story please stay on top of your application. There are so many things that could happen. The guy who helped me (who was extremely helpful and nice) said I was lucky to have gone in when I did or I would've gotten my application denied.

Called to get info pass to get second i-551 stamp before it expires in November, They will call back within 2 weeks to schedule infopass - 10/6/21

Infopass scheduled for 10/26/21 and told 10/28/2021 Interview still on. Went to Interview. Told need to call USCIS for another infopass appointment. Emergency Infopass scheduled for 11/2/2021.
