In general, people receive their Rfe around the same time than the biometrics letter.While you can still get one anytime, I wouldn't worry too much.If you have signed up for case updates, you shall know right away.

Our immigration nightmare continues.

 

I've just received a letter saying that our I-485 petition has been denied for failure to attend an interview. We didn't receive any letter requesting us to attend an interview so this comes as a shock. 13 months, 2 interviews canceled by USCIS and now this. Truly unbelievable. I have received every piece of mail that USCIS have ever sent to me so I'm not so sure that any interview notice letter was ever sent to us.

 

I called the utterly hopeless USCIS customer service line and their information still shows that I am awaiting an interview!!!! How can the information shared within one organization be so inaccurate?! I have taken screen shots of all of the information that is on the "case status" page that shows there have been no updates to our case, as well as all of my documentation of my contacts with the state senator and the ombudsman. 

 

Looks like I'll have to start this process, with its expense, time and stress all over again.

I think you may have a case though... Contact your ombudsman, and an immigration lawyer... 

 

I read somewhere that you can request a review.. but do so immediately.. and theres a fee.. (going to look for it)

It's $675 to file an appeal, just to see if they will re-open the case. I've done some searching around this site and found that these cases are rarely reopened because USCIS will  have to admit fault. So it seems that would be a waste of time and $675 and that I would have to re-file after that.

 

I'm also concerned that my EAD expires at the end of April and that I may have to give up my job. I'd applied for a renewal of this 6 weeks ago but this will likely be denied on the back of the I-485 being denied.

I would talk to a Tier 2 agent ASAP. Also make an Infopass appointment and bring all of your documents/back up. I just made an InfoPass appointment today so I know they have some available around March 30. Try everything you can before absolutely having to reapplying.

Yes, I received the notice in the mail yesterday. I could not believe it.

 

I have also made an Infopass appointment for March 30th. 

 

I also spoke with Tier 2 officer today and they are saying that there is no record on their end of a denial on my case. They have opened a service request to look into the matter. I have also contacted the local senator's office who have been helping me, they have written to USCIS to ask what has gone wrong here. 

 

Also spoke with a lawyer who told me to attend the Infopass and if they do not help me, I need to file an I-290B motion to see if USCIS will re-open my case. 

 

None of this adds up at all. USCIS are saying that their computers still show that my case is pending, yet the letter I received from the local field office is saying that I was denied for failure to attend an interview.

 

It blows my mind that letters of that importance such as interview appointments are not sent with a signature required or certified mail.

Did they mention what was the date of your supposed interview that you missed? They might have mixed it up with your other two interviews that were cancelled. I really hope that's the case because you have proof that they were cancelled (the cancellation letters). You would think they would be more careful considering this is people's lives on the line. I'm so sorry this happened. :( 

 

Please let us know any answer from the Senator or any unfolding with your case. Will keep my fingers crossed for you.

The physical letter I received yesterday said we didn't attend an interview on Feb 16th 2017. 

 

The last update on my case status that USCIS can see is that my interview was canceled on November 10, 2016. That is the information that the tier 2 officer could see. 

 

The entire problem with this whole organization is that you can never actually speak with anyone who can take meaningful action on a case. It's constant red tape and bureaucracy, service requests and waiting game. It's truly terrible.

:( my husband and I feel your frustration... i'm sooooooooooo sorry you're going through this madness.. wth man!

I am sorry this is happening to you, utterly ridiculous!! I dont know the process to fix it but def work with your lawyer, ombudsman, etc to sort this out. This is just not acceptable. Will pray you find a way to get back on track.

Thank you for the well wishes. It's extremely disappointing. It has been very stressful for my wife and she is so upset by the whole ordeal. I suppose we just need to look at it that it will eventually be straightened out. It may take a lot more time and it might cost us even more money but eventually we will be able to get through it. 

 

I will say that if I lose my job or incur any extraordinary expenses or hardship as a result of this, I will seriously consider suing USCIS for their negligence.
