Hello Forum Members,

I have recently mailed my K-1 package to sponsor my Fiance from China. I probably should have asked this question before mailing, but too late now.

When filling out the I-129F, there were two lines available for prior marriages which I filled in and supplied the divorce decree papers from both. I was also married one other time (3rd marriage) when very young. My first divorce was over thirty years ago and there was not a line for a third marriage.

My question is: Will my petition be rejected for not providing the divorce decree from my first marriage 30 years ago? Since I have married twice after that and supplied court documents from both divorces, I thought that was adequate, also there was no space to provide this information. Can I amend or add information to the petition at some point?

You'll probably get a RFE and will need to provide them with the papers no matter how long ago it was it's still a previous marriage. If not enough lines then you should have written on a paper as an attachment.

There was someone that posted not long ago that had their I-129F petition approved, but the K-1 visa denied because they had not listed and supplied the divorce decrees for ALL prior marriages.

When you get your NOA1 receipt notice, you may want to immediately send a copy of that NOA1 along with a statement of explanation with your updated I-129F petition and ALL prior marriages listed along with ALL previous divorce decrees. You can just hope they match it up with your petition.

The instructions state to add an attachment sheet if there is not enough room to answer anything, and that is what you should have done/should do.

Thanks for all the responses,

It seems there is a few different ways to correct this mistake. 1) Do as KayDeeCee said and proactively send the information, hoping that I can connect the revision to the original documents 2) Wait for an RFE asking for the missing document, in which case the method to connect the documents is in place 3) wait for the petition to go through the process and send the missing documents with my Fiance when she goes for her interview, assuming the mistake was not caught before then.

I think I am going to wait until the petition gets to the next stage (after NOA-1), and if I don't get the RFE start making phone calls. If I can't get the missing document attached to the petition during the stage where the background checks are done, then option 3 is about the best I can do. Really kicking myself for this mistake, but I am learning.

I think option 1 is a good idea! As soon as you received your NOA1, send the necessary document you forgot to send. I also read from here (I forgot from which country they are from) but they got denied for K1 interview for not submitting it. God Bless in your journey!

September 26, 2016 - EAD and AP Approval Notice Hardcopies Received by Mailbox
October 5, 2016 - EAD case changed to CARD WAS MAILED
October 11, 2016 - Combo Card (EAD/AP) status changed to CARD WAS DELIVERED TO YOU BY THE POST OFFICE
October 11, 2016 - Combo Card received :) when I checked our mailbox at 4pm
October 12, 2016 - Went to SS Office and changed my name to married name
**No Interview for I485 :dancing::idea::dancing:
November 17, 2016 - Green Card status APPROVED and in the afternoon it changed to NEW CARD IS BEING PRODUCED :dancing:
November 23, 2016 - Card was mailed to me
November 25, 2016 - Card was picked up by USPS
November 26, 2016 - Green Card received in the mailbox : :dancing:

So I have an update...

In trying to be proactive, I called the customer service line for USCIS. They were very helpful and told me that I would need to wait for the RFE to be sent in order for me to make any additions to the petition I have filed.

So, of course, this is what I was trying to avoid, but looks like I will have to wait and of course delay the petition until I can respond to the forthcoming RFE. My fault though.

I know patience is what will be required to get through all this, and I am just getting started.
