Catholic charities can help you for a lower fee especially if you have family at stake. If your waiver was denied, an attorney can appeal in a timely manner. There are a lot of sustained (previously denied but finally approved) appeals on the USCIS. Law. Administrative decisions page.

Did he do an I-601A waiver? That's the waiver inside the US.

It sounds like the person helping you. isn't a licensed attorney. You need to talk to at least one, as I stated, to get actual real legal information. Only you can take charge of your situation. Its your family on the line.

Did your husband enter with a visa, or did he enter without inspection?

Very different to what you originally asked, people do file themselves but I would agree with others who have stated that you need legal guidance.

Did you close his case at the NVC? If not, then no, they won't schedule an appointment for him. If by accident he gets an appointment scheduled in Ciudad Juarez, DO NOT GO. He needs an approved 601A waiver BEFORE the appointment. If its scheduled in error, you can always reschedule.

Please contact an attorney before wasting more money on another waiver.

Remember, you can use an attorney located anywhere in the country. Be sure to ask if they have experience with waivers. Its very specialized and most immigration attorneys won't. Don't waste your time and money on a "notario" or "immigration consultant"-only a licensed attorney.

We did file I 601A and it might of confused many of you here. I just wanted some help on the question that I had .Has anyone gone through it? .Thank you all for commenting I appreciate it. ☺

You need an attorney, I have never seen anyone file a waiver when there is no ban and where one was never requested. Whomever gave you the terrible advice to file one to speed up you case needs to be set straight before they screw upthings for other couples. Sorry they gave you this advice and lead you in the wrong direction. This is a DIY site and your case is no longer DIY

Actually a person can file for a waiver in advance of an interview if the person knows the specific, complete offence. Guidance specifically on that was published last year. It also allows a person to file the waiver and petition concurrently.

I 601 A is something different to I 601, hence the confusion. Basically a pass for those here illegally if that is their only issue.

You file the 601A (in the US) to overcome the presumed 9B unauthorized presence ban in advance of the interview. I think that's what she means by speeding up the interview because otherwise, you file the 601 (outside of the country) and wait months for its approval, to be followed by a 2nd interview. But the OP does seem quite confused.

there isn't a second interview. The uscis sends the waiver approval to the embassy. The embassy contacts the applicant. They send a letter(email) requesting a new medical and police report and whatever else they need. You drop it off at the embassy. Then a few days later they issue the visa.
