They don't really do K-3 anymore so it would be CR-1. And you'll probably be in AP there as well.

You can get married anytime you like; however, you would then need to file a new petition for a CR1 visa. Also, a new petition does not mean that that case would not also result in AP. Processing time for a CR1 from filing to visa is about a year on average (without AP).

At your interview were you asked to provide additional evidence? Were you provided a form asking to send in additional relationship evidence?

Yes but my fiancee had them in her purse so she gave it right there and she cross off everything that was check but she still gave my fiancee the 221g not a denial but ap.

If on the 221g it was not indicated that you need to provide additional evidence, then that is likely NOT the reason for your AP

There is NO finite time when AP should or will end. I know of people who have been in AP for a few weeks and others who have been in AP for many years. Getting your passport back does not necessarily mean a denial. In the end if what you really want is to be married now, then get married and file a new petition. Just keep in mind that a new petition will take time to process and at the interview you may end up in AP again.

Wait for their decision but if you feel you have more and better evidence now than you did before, then you can withdraw your case and file I-130 after you get married.
