PLEASE HELP, MOM VISA REFUSED- WHAT TO DO NEXT (merged)

Very good explanation NLR. I honestly think that a lot of foreigners are ignorant (and the word ignorant should not be taken as an insult here) on how strict the rules are when dealing with immigration.

  • You can't work on a visitor visa.
  • You can't go to public school on a visitor visa.
  • You can't use the visitor visa as a permanent residency.
  • You can't use family member's visa to have another family member (even if it is a minor) "tag along".

worriedgirl, unfortunately strict rules were broken and they need to be cleared up before your mother and sister can be considered for a visa.

I absolutely agree with the ignorant statement! i cannot believe knowing what I know now that it was possible for my sister to have attended school. She is a Canadian citizen, came in with a canadian passport. My mom had a b1/b2 visa.

Your sister cannot immigrate to the USA at this time. Im unsure why you petitioned for your mother knowing your sister cannot accompany her. Your sister, as a minor, cannot accumulate overstay, she simply does not have a valid immigrant visa.

Even if your mother has an immigrant visa, your sister cannot move as well.

Now an immigrant visa is not a 10 year visa. The green card upon entry would be a 10 year green card but the visa itself only works once. Do you mean her tourist visa was cancelled or her immigrant visa? Shes already had 2 interviews and now is going for a 3rd?

We are only petitioning my mom and we thought she could turn around and petition my sister. She is about to have her second interview. Her b1/b2 visa was cancelled. The immigrant visa shows refused on CEAC now. I am now worried she will have some sort of ban and hoping not.

Is it even possible since the ceac already says refused?

Could it be possible that when Mom went with sis to come visit after sis had overstayed they thought she was smuggling?

Do you know anything about alient smuggling ban? my lawyer thinks that this is probably be the reason.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

However if your sister went to public school as a tourist, that is a big no-no and your mom will continue to be denied. Public taxes pay for public schools. School isn't actually free; the building and grounds need to be maintained, the teachers and workers paid, the lights kept on. All of that is paid with our taxes so a tourist, who does not pay taxes, isn't actually entitled to use those facilities. A private school likely would have been fine.

I agree that the bill for your sister's schooling will need to be paid.

Why were you the one enrolling your sister and not your mother? I'm surprised they allowed you to be the one to enroll her to be honest.

To the OP... Canada is a separate country from America. I don't know why anyone would think they could go to school here as a Canadian or the other way around for that matter. I legally immigrated to the U.S. with my kids and the amount of paperwork I had to produce just to get them enrolled was extensive. I'm shocked by the lack of documentation that your sister's school district required. Obviously it is very inconsistent but the person who enrolled her in school should have asked for evidence of her being a resident. I had to show EVERYTHING including documentation for custody since I am divorced from my children's father.
