This quite a bit long hehehe! My f just received an email so we're 221g...

_x_ 1. You need to submit the document(s) marked below. The required 221(g) documents may be submitted to
1201 U.S. Embassy Manila, Roxas Boulevard, Ermita, Manila, Philippines 0930.

_x_ Others: Please provide us your complete court records, including indictments, charges, transcripts and judgment of the case for Battery charges and unlawful entry charge.
In the event that a court record is not available, please provide official confirmation from the court that your record is not available, including the reason for the record’s absence, and in the absence of the official record, provide a narrative of the incident(s) in question.”

So the question is, who should send the documents requested? Can my f send it directly to the address listed? Does he need to send them the original copy?

With that case as well, the court's verdict is NOT GUILTY, since they we're attacked and he only did it on their defense. He doesn't have the court records, he only have the disposition saying that he is not guilty. Is that enough to send them?

He also called the number listed and the guy told him that I should go to the court house in Davao about this case, "applicant has to go to the court house in Davao City to get these records", what does this mean? The case is Battery charges and unlawful entry charge.

Can someone enlighten me please. Thanks.

You are the USC and the court records was asked from your fiance who applied for the K1 Visa, right?

He should provide:

complete court records, including indictments, charges, transcripts and judgment of the case for Battery charges and unlawful entry charge.

"applicant has to go to the court house in Davao City to get these records", what does this mean? The applicant is your Fiance, he applied for the K1 in US Embassy Manila. You are the Petitioner. If he don't have the complete documents, he can go to the courthouse in Davao (where it was filed and dismissed) and request for a certified copy of his complete case.

Does he need to send them the original copy?- do not sent originals if cannot be replaced. Certified true copies are fine.

Hi Christina thanks for the quick reply. I am the beneficiary and I am from the Philippines. My fiancee is not aware of the unlawful entry case. The email is requesting court records, indictments and the likes for both cases battery and unlawful entry. The thing is, my fiancee is not aware of the unlawful entry case. He never had any knowldege that he had that case. How do we do about that? Let's say once he get to the courthouse in Tampa and they have no records of the case in his name what should we provide? Is a statement from the courthouse in Tampa saying that he doesn't have any unlawful entry charge enough? His worry is, someone might have used his identity and thus the exsistence of the case. As for me I have never been outside of my country and my NBI Clearance doesn't show any records of any criminal case against me.

When your USC fiance have the complete docs, he can send it from US direct to the embassy manila address using Fedex. Tell him not USPS.

I assume you have declared the case/s in your I-129 f thus you need to provide complete docs.

Did this involve you or your fiancee, the person involved is the person that gathers the documents, then YOU take the requested documents along with a copy of the 221g email to 2GO for delivery to the embassy.

Your post is all mixed up making it very confusing.

So during your interview at the Manila embassy you were given a 221g; the email was the docs required for the 221g which is you need to submit your USC Fiance's complete court records.

Can you clarify more? You mentioned the following:

When your USC fiance have the complete docs, he can send it from US direct to the embassy manila address using Fedex. Tell him not USPS.

Would that be enough to send them since it has the court's seal?

The case is Battery charges and unlawful entry charge. - why are they asking you to go to Davao, Was there a case filed in Davao against your fiance? --- I believe my fiance was misinformed when he called the Embassy Call Center last Monday, coz when I called them, I was informed it pertains to his case and he should provide it and that we follow the instruction. The case was filed back in 2003 but that's just for the battery. And he has no idea of the unlawful entry charge. Is there a possibility that Battery and Unlawful Entry were filed against him in 2003? It wasn't stated on the disposition though.

As of this writing my visa status in CEAC is AP.

Yes we will be working on this. However there were two cases right, Battery AND unlawful entry. He knows about the Battery charge but not with the unlawful entry. That's where his confusion is. How come he has a case like that without him knowing.

As for the Battery charge, I get it that the case disposition is different from the court records, including indictments, charges, transcripts and judgment of the case. Am I right with this thought?

Yes we will be working on this. However there were two cases right, Battery AND unlawful entry. He knows about the Battery charge but not with the unlawful entry. That's where his confusion is. How come he has a case like that without him knowing. - He should find out, only him can check on that.

Am I right with this thought? - We cannot assume on anything about his disposition document, only him knows the case and what was on his disposition papers and what were done on the case thus the disposition was reached. They have reached a settlement, thus he have the disposition letter. Still he need to get complete records pertaining to the case. as required by the Embassy. Disposition is the JUDGEMENT part of the case- he still needs indictments, charges, court transcripts as required in your 221g.

Hi just an update with our case. After sending 221g request we got refusal from CEAC website :cry: .

It says they will send us a letter regarding the refusal. We sent them the documents on March 29th then on April 4th it went ready. After a few hours it showed REFUSED. I sent them an email about the refusal but there's no reply sent up until now. I also noticed that the date changed from April 4th to April 7th. What does that mean?

Also, when will I receive my passport back?

What will be our best option? Can we do CR1 and not wait for the letter and get married let's say next month? or better we wait for the letter before filing for CR1?

You email embassy for PP & talk to an atty this is very confusing

who is thee USC was he deported & why, did he re-enter, was

all info disclosed on initial application ? that was a quick denial

as if either the paper-work was not properly done or no eligibility exists
