I received indisputable proof that my wife (Dominican) who I supported for 2.5 years sending her money weekly. She received her Visa this past November and arrived here PA. on November 14th. On Jan 1 she said that she wished to return to her country for a couple of months until the weather warmed here. During the past 24 hours, I received indisputable proof along with Videos of her with other men (Many) (Recent Photos beyond a doubt along with written confirmation on the truth of this with sexting photos the she sent him from my apt here in the US, and a cell phone short video of her performing ####### on on of her boyfriends. I got his phone #-he is a Police officer in the Dominican Republic, and . There are also numerous photos of her and him snuggling and kissing including some at the airport with her holding her passport and visa which I sent her. The was also another photo of her intimate with another man. She was to return here on April 8 but today I cancelled her flight and look to file for divorce. I am looking for some information on what option are open to me and what the procedure is for process of service in the Domincan Republic. I appreciate any advice either legal or through experience from anyone with a past similar situation.

Thank You.

I take it you know her address so serving should not be an issue.

Reasonable to assume you were not the only one 'supporting' her.

Do you think she intends coming back to the US, you are of course still on for the I 864.

Sorry you are going thru this. Good for you on canceling the flight, I'd pay to see the look on her face when she gets to the airport and is told that your ticket has been canceled. I hope you didn't tell her yet. File for divorce and forget about her. Chances are she won't ever be able to get back to the US on her own.

Good luck.

Sounds like you have proof the marriage was fraudulent and for immigration purposes. Make an infopass appointment and bring the evidence in to report this. As she has her green card, you may not be able to stop her from returning, but possibly you may be able to stop her from renewing her green card. ICE which is responsible for chasing down fraudulent cases and having them deported, in general don't bother with single cases, they just don't have the resources. But you could attempt to report her with your evidence to them also.

From OP's timeline, marriage date is 2014-01-18.

Wife arrived in US on 2015-11-14

Less than 2 years of marriage, so still CR1, isn't it?

Done with K1, AOS and ROC

Removing conditions is no biggie.

It could be though if he turns in real evidence of fraud though. Now truly having that evidence is another story.

yes, that would still be a CR-1 requiring removal of conditions.

Could count on the fingers of one hand the number of times I have seen real evidence mentioned.

I agree with your there. Usually its a he said she said situation. But this guy has photographic and video proof of infidelity as well as text statements of the person it was done with. The big question though, is that enough? They might say fidelity is not a requirement of a valid marriage.

Infidelity is both common and not a cause in itself for a finding of immigration fraud.

There have been many similar cases and nearly all involve infidelity.
