Note: Evidence of a bona fide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bona fide marriage. They list examples of acceptable evidence as: 1. Documentation showing joint ownership or property; or 2. A lease showing joint tenancy of a common residence; or 3. Documentation showing co-mingling of financialresources; or 4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or 5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and details explaining how the person acquired his or herknowledge of your marriage); or 6. Any other relevant documentation to establish that thereis an ongoing marital union.

Provide evidence that you have a legitimate relationship, not one that is simply to gain a visa.

1. Documentation showing joint ownership or property;

My wife and I bought a canoe and included both names on the state registration.

or 2. A lease showing joint tenancy of a common residence;

Easier if you are renting and move to a new place. A little harder to add a name to an existing mortgage.

or 3. Documentation showing co-mingling of financialresources;

We added her to my bank account, she got her own debit card. Also added her name to the Electric and Gas bills. Also both obtained library cards.

or 4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together;

Obvious.

or 5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and details explaining how the person acquired his or herknowledge of your marriage);

Had my sister and a family friend execute these.

or 6. Any other relevant documentation to establish that thereis an ongoing marital union.

Photos around the house, at museums and zoos and on vacations.

Magazines sent to her at our address.

Obvious.

so this means we can use our birth certificate for the evidence?

If the two of you have a child together, then yes of course. What better reason to have a relationship than provide for a child together.

Yes that is one form of evidence. The link that was provided some responses above lists many different types of evidences.

Also if possible, add her to your credit cards, auto insurance, Life Insurance polices on each other, naming the other as his or her beneficiary.

Joint checking and or savings accounts.

Any mail addressed to both you and her.... Utility companies usually add spouses name with no issues or questions.

Any receipt showing yours and her name on it, even if receipt for a lamp $10.00 lamp.

Thanks so much for the response, uhm if i only do the joint accounts like add her to my bank accounts would that work for my evidence if i am only going to use that as a evidence or do i need to do more?
