My daughter's CR2 visa was denied yesterday by USEM, Manila. Consul stated that she was already 18 years old when marriage occurred between me and USC husband, the petitioner in this case.

As she is turning 21 on July, 2016, what is my best option - F2A or F2B? I am a LPR.

Please help with your advice. My lawyer is out of reach and I just need to start with something asap. Really appreciate all the help.

Ask USCIS if she can retain the priority date and when you filre for F2A then attach (email) request to expedite. Its a bit late but there still little hope. If they will not approve your request to expedite then most likely her case will fall under F2B (longer waiting period).

Sad to say, you have taken a wrong immigration route. You could have filed a petition for your daughter when you had your LPR status.

Step-father / step-child relationship should have been established before the child's 18th birthday.

File now and hope for the best, use her A number if she one on the approval notice. Attached a letter explaining your situation and asked considerations from USCIS.

Receipt Date: Sept 2

NOA 1 Date: Sept 12 (received text/email)

NOA 1 copy rcvd: Sept 16

Oct 13- Case ready to be scheduled for interview

If your lawyer filed this find a new lawyer.

Not sure time is of the essence in this case.

There is no expedite for LPR classes, they must wait until the priority date before any thing like that can happen.

This will not be over quickly. You will not enjoy this.

There's no such thing. You have to start from the beginning file a I-130 pay the fees and wait out the time. There is no expedite or fast track for green card holders because you have to wait for your Priority date to become current. There's no appeal because USCIS made no mistake It's best to do it now.
